When you go to court for custity and one party said the other does drugs is it a urine test that would be given or a hair folicla?
this would be the frist court apearnce.No drug history just someone saying he does drugs!

Okay…I have smoked weed 4 times in my life…once in the middle of December, once 2 weeks after that, last weekend, and the weekend before
Not a lot all times, 2-3 hits max.
I’m 5’3″
I weigh approximately 140
(muscle and fat both…)
Last time I smoked was Saturday night. It was around 10 or 11 at night…2 hits, one was mainly resin… (and I was drinking, in case alcohol can effect that somehow?)
I’ve been taking cranberry pills, drinking iced tea and water… my pee is really clear? does that mean I’m cleaned out?
Is there anything else I can do if what I am doing isn’t working…
I know not to smoke, I’m not gonna do it again so I don’t need a lecture, I just need help!
(the test is between 6:30 and 8:30pm, whenever I feel like going between those times)
to every one of you who said I would fail, I passed, so I guess anyone who needs help in the same situation can do what I did…
Only side effect is my throat is killing me from all the Arizona Iced Tea and water…

nope…you smoke weed it takes -6- wks MINIMUM to get rid of it from your body…

This is my first offense, im 17 and i received a citation for underage possession of alcohol (1 beer).How likely is it if at all that they will perform a court ordered drug test? I live in chicago, illinois. Also does something like this come of my record when i turn 18?

The court can require you to do anything including providing for a drug test.
When you turn 18, your juvenile record will be sealed provided you are not actively on probation beyond 18.

For those of you who don’t understand my question, HERE ARE THE FACTS:
1. The 5th Amendment says that “no person shall be compelled in any criminal case to be a witness against himself”, which is another way of saying “you have the right to not incriminate yourself”
2. Anybody who submits to a drug test is committing an act of self-incrimination
3. The Exclusionary Rule states that evidence obtained by illegal or unconstitutional means cannot be used against the suspect in question
Therefore, we can safely assume that any criminal who is asked to submit to a drug test can say “I plea the 5th Amendment” and refuse to submit to a drug test. We can also assume that if the authorities drug test someone by force, they cannot use a positive test against the suspect cuz doing so would violate the suspect’s 5th Amendment rights and as such ALSO violates the Exlusionary Rule. It all seems perfectly straightforward and simple, but clearly this is not the case cuz people who refuse a drug test automatically get arrested. Can someone explain to me why the 5th Amendment doesn’t give ppl the right to refuse to take a urine test or any other type of drug test?

Because you are not testifying. You have evidence that needs proof. It’s like a DNA test in a murder trial. You don’t have to testify but you do give a DNA sample for proof.

okay so i got caught for possesion of under an ounce and possesion of under an ounce of marijuana within 1000 feet of school and im getting drug tested on the 9th of march i smoked 2 days ago cause i was stupid and i feel soooo stupid i asked my mom to please schedule it for the 14th and she said the 9th i said well i im gonna fail and she said “well i guess your going to juvie” and i flipped out! i cant sleep or anyting cause i dont want to go to juvi before the last time i smoked 2 days ago i didnt smoke for 16 days i told myself i wouldnt do it again but some people said i would pas in 18 days and i prob would of but my mom sceduled it for the 9th im 14 and 5’8″ and 110 lbs so im really skinny my question is what are the chances of me passing? and what will happen if i fail? will i go to juvie?

This answer won’t get best answer, and I mean this with care, but….
As far as I know, all of the “homemade” remedies for detoxing are wives’ tales and don’t work. I’m sure you’ll have some answers that give them to you anyway. For the sake of staying out of the judicial system–I hope you find one that works.
I would think, however, that if you are broke, the best detox solution is to not buy any “smokes”. Problem solved.

They will also test for stimulants such a methamphetamine and cocaine and opiates such as morphine and heroin.

If there is a reason for missing the test, than there wouldn’t really be any penalizing.
If the person just didn’t show up to the test, than that could probably go as evidence not in their favor. Seeing as it seems that they neither care nor are they willing to take the test…..which pretty much means there is evidence of them using drugs.

I got caught with a gram of weed in my dorm room in like january, i have smoked since then, alot, and i just recently had court and discovered that oh hey they want me to take 2 drug tests one in less than a week and one in three weeks. If i drink a shit load of water and take vitamins before my test could i pass. for the past few days ive been drinking a boat load of water and working out, trying to do alot of core exercises. But i dont know if ill pass this first test, whats going to happen? Oh and since i got caught at a strict ass private school they already punished me and my roommate a shit load, and threatened to kick us out, gave us community service and are making us write stupid ass papers. and the judge is making me write a paper too. and this is all for 1 GRAM OF WEED! REALLY?!
We weren’t smoking in our room and we have cooperated with everyone, school officials, and police. We have done everything they’ve asked. what does it mean to be held in contempt of court?

IF Provigil is one of the drugs that is included in the tests, Yes, this will show up in the report. IF this is a prescription drug, the Court will ask for proof from your Doctor that he prescribed the drug, at which time the Court will not question its use.

the thc in his system I could live with but he failed for morphine claiming he took a vicodin?! he is an ex heroin addict, and now I dunno how you get morphine out of a vicodin, but all I wanted was supervised visits and since I was declined for representation in court I need a few answers as to why they didn’t at least revoke his visitation untill he comes with a clean test I mean what the hell they are just giving kids away to junkies these days now I have to let my son go with him twice a week (provided he remembers) which he normally doesn’t…anyways I would like some advise on how to get court ordered supervised visits so I won’t need to worry everytime my son is with him

I’m 17 and got an alcohol charge six months ago and I had my license restricted for six months, 33 hours of community service, and substance abuse evaluation. i had to get a drug test at my evaluation and i passed; however i go back to court on the ninth and i was wondering if i have to take another drug test. any answers helpful. this is in virginia beach by the way.

The oldest use will be reflected at the end of the longest hair, most recent on the part closest to the scalp, so depending on how long the hair is it will show years of drug use.

yes drink a lot of water.. and drink vinger yes it is nasty but it helps clean out your system and get rid of the drugs that are in your body.:)

I am the mother of a 4 year old little girl who is my whole world. Her father and i have been divorced for over a year now and thus far visitaion hasn’t been a problem. However, something has come up recently to make me believe he has started doing drugs again. I did some snooping around and in fact he is, I have printed out emails from him to another party where he is admitting to using drugs within 24 hours of picking up my daughter for his visitation.(there is a long history of drug abuse) I have hired a lawyer and we are asking the court to drug test him before we resume visitation. I know i have to let the lawyer do her thing, but you never know how things will work out. All i want is a drug test, if he is on drugs we will take it from there and if he isn’t i will owe him an apology. My question is has anyone been through this and are the emails enough to order a drug test?

Im on random drug screens, and I havnt smoked in 32 days but I have failed two drug tests. They use the instant dipstick urine analysis but do not send it to the lab (i pour it out after they test it). Then after failing the second test they tell me i need to re fill out their forms giving them a newer date of use. but I havnt used! So I have to pay an additional dollars to have it lab tested, to find out what I already know. I have been a consistant every day heavy smoker for 3 years, and they just assume that after 4 weeks I should be clean or atleast near the cutoff date. This is court ordered and in the past, as a juvenile, (6 years ago) They lab tested every sample but now that doesnt seem to matter to them. The first test was 21 days clean, the second was 32 days clean. im afraid in 2 weeks when I get tested if I fail I will have to pay another for nothing. do I have a case to argue and possibly get my $$ back from my probation officer?
well that makes a lot of sense, I do pay for the test already and they could make me get a lab confirmation and pay for that too. And i’m not paying to contest the fact, and saying its a false positive. Its positive because the metabolites are still in my system. Everybody’s body is different, to say 30 days is the average is rediculous. Thanks for the responses!!
Its the fact that i have to pay extra money, or fill out a form stating I used since my last date, which would be a lie. I guess im more worried about my PO not understanding my situation, I guess my best bet would be to pay the dollars everytime atleast then he will see the levels are dropping. no thanks to that first answer, wh*r* up the points you troll.

this is in clay county florida and the magistrate has placed the child in the home on the father pending a child custody evaluation. the magistrate also ordered a drug test for both parties, mother and father. the father ( where the child is residing until final hearing) has failed his drug test with marijuana in his system. the test was a hair strand test. the mother past her test. WHILE I KNOW THAT THE FAILED TEST CANNOT LOOK GOOD TO THE JUDGE HOW BAD DOES IT REALLY LOOK? THE CHILD IS 16 MONTHS OLD.
THE CHILD WAS IN THE MOTHERS CARE FROM BIRTH TO 16 MONTHS. THE MAGISTRATE ORDERED TEMP. CUSTODY BE WITH THE FATHER DUE TO THE MOTHERS OUT BURST IN COURT. THE FATHER TOLD ALOT OF LIES AND THE MOTHER COULD NOT CONDUCT HERSELF. THE FATHER HAD NEVER PAID CHILD SUPPORT AND HAD ONLY MET WITH THE CHILD ON 6 SEPERATE OCCASIONS ( THE FATHERS CHOICE). THE FATHER ACCUSED THE MOTHER OF DRUG ABUSE IN COURT BEFORE THE MAGISTRATE. AGAIN, SHE DID NOT FAIL THE DRUG TEST BUT THE FATHER DID. I JUST WANT TO KNOW HOW BAD THIS WILL LOOK ON HIM BEFORE THE CHILD CUSTODY EVALUATOR AND BEFORE THE JUDGE AT THE FINAL HEARING?

The judge should reverse his original order and award the mother custody based on the evidence unless there are other unsaid circumstances prevailing in this case.

My X-husband and I got divorced about 2 years ago. Mainly because he got into drugs. He had passed a drug test though during the divorce (urine test) because he knew it would come up by the judge so he prepared. Now two years later we still have shared parenting–he has drastically dropped weight and I know for 100% he is using again. A friend of his has now come to me with with details stating he and the gf are on heroin, Oxycontin, adderol and percocet. So ASAP I called my attorney to set up a Court Ordered Hair Follicle test to get my Daughter out of his custody since we are shared. Do they normally take them down to just supervised visits if proved guilty??? I am hoping they will force him to get help…because its no longer and addiction with him its an illness. He recently had a heart attack according to family and he is 29! Do you know how much notice they give them before the test….because he is the type to shave all parts of his body to avoid testing. I just hope its not to long for him to quit just for the test. I am really worried for my daughters safety and his health. Especially since my daughter loves him so much. Only kind responses please………

Your lawyer will likely petition the court stating that he is putting the child in danger. They will likley give him a drug test. Three of those 4 drugs are legal, and unless he is acquiring them illegal, they won’t hold weight. A hair follicle test is good for 90 days. So if you can petition the court and demand he take the test within 30 days, then your safe. If he shaves everywhere this will be noted and the judge will likely order him to take counseling courses and change his supervision until he gets therapy.

Ok here’s the deal, I am fighting for custody of my kids ages 6 and 5. My ex uses and deals drugs for a living. He has no way of supporting the kids legally anyway. My attorney asked the judge for a drug test on both of us to determine whats in the best intrest of the kids. The judge issued it. I went straight from the court house to the place where we take the test because we were ordered to be there by 5:00pm. I passed mine. That was almost 2 weeks ago. My attorney hasn’t recieved any results from the ex’s attorney. He either didn’t pass and they are hiding it or he didn’t go. We have court on Friday the 19th. I am nervous. Not sure if this is enough to get the kids away from him. Also he lives in a 1 bedroom shack with his girlfriend her son and my 2 kids. Possibly more people.

I would think that the judge should ask him for financial info as well. pay stubs, tax returns, etc. If the drug thing isn’t enough ask your lawyer about that stuff.
