My husband and i are raising 5 kids,from 3 up to 14,we are happy,steady and comfortable right now,DFCS called and said there was allegations of abuse,which there’s no way,and pot smoking,we smoked the other day and now i’m terrified i’m gonna loose my kids! I’ve never been in a mess like this,can they make us take the drug test without a court order or even a case against us???
I tested negative and my husband tested positive!!

No worries Amy they cannot take your kids away over pot. You say that they claim abuse, if they can prove this then yes they will. But you say you did not and if true you have nothing to worry about.

Just so you know Amy it is abuse to use illegal drugs in front of your children. If your own children told someone that you were smoking pot and they passed it on to DFCS, you could be in VERY big trouble.. just an fyi

If you are in court ordered drug counseling while you are pregnant and you fail a drug test for marijuana can social services take your baby away when it is born? No, I am not pregnant or a marijuana smoker, I’m just wondering about a conversation I had with someone today.

well 1- its not good to smoke while pregnant… it would be wise for her to quit… 2- they very well could, cause that would consider that person an unfit mother…

If the mom test results comes back positive for drugs, will the judge take the baby right then from the mom or wait till we go back to court July 29th and take her?

Has anyone been in this situation or know of anyone that has? What was the outcome?

We are in Oklahoma. Our son took the same test and his test came back negative.

The child will be taken by police and taken to child services or they will come take the baby themselves. I know you can take steps to get custody so you don’t loose her to child services.

And she can get her kids back eventually as long as steps are taken by her, and she follows rules.

The person is charged with Contempt and goes to jail. The hair is taken from them while in jail.

NEED HELP! Five years ago, I would have never needed or considered doing this. We were a very stable middle class family. I had raised two children and decided to go back to school and take some classes in psychology. I became very interested in that and social work and soon quit a 20 year job to return to school. Cutting our income in half was bad but after winning an academic scholarship at the end of two years, I went on for a degree in Social Work. I drove 100 miles per day to school. In the meantime, everything went haywire. I graduated in May of this year and have not gone to work because of family responsibilities. While in school, I dealed with a son in drug addiction but now with a long period of recovery. He became a father out of wedlock to a precious baby girl in 2003. She was abandoned to him at 2 1/2 years old with mother coming back in a few months. Shortly after, a 1 1/2 year custody battle began that became ridiculous. He now has custody of her. Both of them live with my husband and I. His work has been cut by the economy to part time. He has no government help or child support aiding with this child. My husband has just had a week a month cut from his job due to economy. Our savings have dwindled away with attorney fees, medical bills, even with a bond to get me out of jail on a false criminal charge. If not for my education, I would have never considered this lawsuit, but I have watched wrongdoing of Childrens Services, classism, false accusations placed in agency files and passed around to others for months concerning me when they were not only untrue but could have been easily tested for validity. Some of these things I have documentation of, a tape recorded interview with the head of an agency showing many mistakes, etc. Other things, I have very strong circumstantial evidence concerning. Nobody here wants to fight the state. The DA’s office sure doesn’t want to be involved when they work for the state also.
Some of the many issues include:
1) Sexual abuse of my then 2 1/2 year old granddaughter. The story came to me after a long period of talking about this person in a very traumatic story one night after seeing his father who looked very much like him. I asked her to tell dad and granddad the next morning. She said enough without going into details as she did with me. They took her to Childrens Services. It was thought that I MANIPULATED the child to tell this, and I doubt was ever even documented.
2) Mother and father still had custody but both sets of parents were ordered by the court to supervise with parents at all times, including me. At the same time, they held a document saying that I was believed to have character flaws, mental illness, abuse prescription drugs, and take illegal drugs. Do you leave a child with a parent that needs supervision to be done by someone like this?
3) I walked out of a Family Meeting according to them because I was unwilling to compromise or something similar. I did walk out and told them the reason why. I had listened to what would be to everyone’s convenience for half an hour. Not once did I hear anything concerning “what was in the best interest of the child.” They also wanted both parents to sign away custody to grandparents. My son refused to do so without it being heard before a judge. I refused to sign to take custody until both parents were said to be unfit before a judge.
4) My son’s lawyer called and asked to see him and that he bring parents. When we got there, papers were already waiting for everyone to sign. Based on a conversation with Childrens Services, she had decided that there was no use representing him. She wanted him to sign rights to us. She would then become our attorney and fight to be able to get us JOINT custody with the other grandparents. She was fired.
5) For about two years this child did not know where home was. She usually was ordered to spend three days at one place and four at the other.
6) My son had held temporary custody since the abandonment. One night probably a year into this hearing, she was talking to me in bed before going to sleep. All of a sudden she said, “Don’t you know that my daddy don’t have custody anymore. Nana and Papa do” I just let it go and said nothing. The next morning I went to the courthouse to see the documents of the hearing. She was right! For 5 months they had held custody of the child. My son nor any of our family realized this. It was done on a court date where the judge had plainly said that he would not discuss custody that day…only visitation. He sent us in a room to decide on visitation for the next 2 weeks and said when settled, we were dismissed. The grandparents lawyer came out and returned to the podium. He said “your honor, we have one piece of business that we didn’t address.” The judge asked what, and bringing the paper to the judge, he said that it was the visitation agreement that we had made to be signed.
I would LOVE to at least have some more comments here!

We require more American Answers,as the UK system as i know it so unlike the US,
This must have been hell for you, I’m sorry you have had such misfortune.

Apologies for my previous answer,i couldn’t take it all in as i was sleep deprived from physical pain.

The law here would require some objection to any treatment to have been made within three years of any such treatment-spoken to my solicitor-so his take,if happened in the UK

The solicitor here (UK) would have to have very specialised training on family law,mine has a partner who does this,and she is always working.

The healthy, ‘child comes first’ attitude you have ,has been ignored and misunderstood,possibly,and also can be used as some ‘fake’ diagnosis to keep lawyers on the take/make

prolongation of cases traumatises the Child and those who love her.

This is horrible to have happened to anyone,of any social background.

If there is a reason for missing the test, than there wouldn’t really be any penalizing.

If the person just didn’t show up to the test, than that could probably go as evidence not in their favor. Seeing as it seems that they neither care nor are they willing to take the test…..which pretty much means there is evidence of them using drugs.

none of them seem to fit implied consent to my knowledge…however the most correct answer would be if an accident has occurred.

Implyed consent normally occurs when one is unconcious and it is needed to determine if a crime has occcured…in which case I would go with the accident one.

It depends on whether or not they’re mandated by the court to be there. Most rehabs are voluntary.

CPS is trying to take my baby twins on a false accusation made by my boyfriends mother wants them.?

My boyfriends felon mother wants my baby’s. Her felony and age keeps her from being able to. her daughter, who lives with her is the one going for the adoption. It is said that the CPS social worker has been paid by the mother to make sure they can take my twins. The report she made was that I was crazy and was going to drive myself and my baby’s into a lake. This is outrageous!! Also Untrue!! The social worker took them from me on “threat of abuse and neglect”. This is also outrageous! I left my boyfriend in june. Got our own place. Things were great, then on Sept 9th, she made the call because my boyfriend was sad, he said. Now my baby’s live foster cared with my mother. I only see them supervised one time a week. Supervised for 2 hours. The lies that the social worker submits to the court about me are ridiculous. My boyfriend is in jail for the past 3 months and is ordered to check into a rehab for 6 months. He claims the so. worker has a crush on him. It shows. My required therapist believes this also. I have been tested for drugs about 60 times, all negative, of course. I have been tested psychologically and received great scores. Although, the so. worker changed the results for the court docs. My therapist actually received the true and fake results and just notified me of the forgery. The entire case is a fraud and my baby’s are in turmoil as myself. We cry every week we must be torn from each others arms. I applied for an atty. buy the so worker told the gal at the courts, (her personal friend) that I’m rich because, I had her over to my home, and it is quite nice.She declined my ap. Social worker claims now that I lie about everything. She submitted to the court that I’m suicidal and have made threats of murdering her, my baby’s and my boyfriend. She claimed the police had 5 reports of this and I should be admitted to a mental ward. The police have no record of this at all. She may need to be checked in. I just need an Attorney DESPERATELY!! How can I get one and get my Baby’s back. I’d also like to file against this CPS worker and the state for treating us so wrong! My daughters were 9 months old when taken. They are now 16 months. We are in dire need of help. We have been wrongfully accused, separated and judged. There is no proof to her accusations or investigation.

Am I right to stop visitations and wait for him to take me to court?

I have been court ordered to give visitations to my children’s father. He is a recovering addict. (Hooked to drugs) He is currently in a half-way house to sober up for the time being. This is his 4th trip to a rehab type program.

I have reason to believe from my daughters mouth that he has touched her.
He doesn’t plan his visitations until the day before visitation so I can’t plan anything for my day until the day of.
He has made me late for work 3 times for not showing up on time for pick up.
He has a violent past against me. I have a restraining order against him.
According to the parenting guidelines in my state he is legally suppose to give me his address and refuses to.
He has taken the kids over to a womans house that we both know has done and sold drugs before.
(His brother took them over there today)
He was suppose to take the kids to church to observe Easter Sunday and did not take them as he promised he would.
He has also admitted that he calls the kids for an excuse to talk to me.
I have spoken with an attorney and he said I could stop visitations but i could get caught with contempt although every thing I have it should get thrown out.

I am trying to protect my kids and the courts here aren’t helping.

What steps do i need to take to become domiciliary parent for my son?

My sons dad has been out of town for over a year in a court ordered rehab, but he will be back this month and I know he wants to be in his life, but we were never married both of our names are on the birth certificate. We do not have any type of custody agreement on paper, child support anything. I am scared that he could pretty much take off with him and there is nothing I could really do immediately. The way I understand it in the eyes of the law we share equal rights as far as his custody goes. I need to know where to start to get this on paper. I am single mom and am not sure I can afford to go through a lawyer. Please Help, thanks
