Does a parent have to pay child support while in a court ordered rehab?

My husband’s ex lives in KY. She is the noncustodial parent & should pay child support. To make a long story short, in December, 2 days before the kids were to go visit her, she was jailed for first degree assault & ordered to go to rehab in TN. We didn’t know any of this until 2 months later.
The TX Attorney General has told us that there is nothing they can do at this point they are basically waiting until she’s finished w/her rehabilitation and final court date in Kentucky in September. I am sure that she didn’t tell the judge she was ordered to pay child support in her initial hearing. I wonder was she suppose to?
As a step-parent, my heart aches for my kids. Yes, I said my kids. They’ve live with me for the past 5 years, mom brought them to me & she moved 3 states away. I’ve written her asking, begging practically for her to return to her children. Expressing their sadness that she left them… & no response. I am frustrated. Thank you for your help…

How do i support my boyfriend, and ex-drug addict.?

I havn’t been w/ my boyfriend to long. But i care about him soo so much.. He is an ex-drug addict. He has been to jail twice for this, done a lot of really really bad things, that i can’t even mention.. Now.. he has been out of jail for 8 months, and was ordered by court to go to rehab for four.. so he has been out of that for four months now.. he has been sober from all this for 15 months now. The reason i am concerned, is not because i don’t trust him.. i know he can do this, he is a born again christian, and has done a complete 360. But most of his friends smoke weed, or some pop pills.. i am just afraid this is a bad influence on him, but i can’t tell him waht to do. do you have any advice on how to support him in this matter? Also he has recently decided to give up drinking, because he’s afraid of it being an addiction like drugs were. and also all his friends drink all the time, and when they come over thats what they do. Again, i just need to know how to support him.
He has told me that he would prefer if he stops drinking that i could do it to. because it would really help him. (see i only drink if i go out,, which is only a couple times a month) I told him this wouldn’t be a problem, i will do anything to help him out.. i am doing the right thing right? it’s not going to be hard for me to stop drinking at all.. i don’t drink much as it is. .. and i have never smoked anything. so that’s not a problem.. He’s an amazing person, and since he has turned to god, a lot of prayers have been answered. he’s down the right path, and i want to keep him there.
another thing.. i am just really scared.. i am falling for him, and i don’t want to get hurt w/ him just going and falling back into it.. plus i have a son (one year old boy) and i am trying to be extra cautious for my son’s sake.. i don’t want us to get hurt.. I trust dominick completely.. i guess i just need to pray about it, and let god lead him through this. I would never put my son in a bad situation… and dominick is amazing w/ him, and he treats me like an angel.

Kids’ dad left the state owing child support…?

My and I went to court in October because he was not paying child support. (His excuse was he was in court ordered work release rehab for drugs and he could not hold down a job.) Anyhow, because of his legal problems, he could not see the kids for over a year (child endangering). In an effort to intimidate me into dropping the support case, he asked the court to grant him visitation with the kids. He was given supervised visits and in 3 months time, he only scheduled 3 visits. Thats how interested he was. Anyhow, we were due to go back to court in Feb. Three weeks ago, he took off for another state and has told family members he has no intentions of returning here and already has another job where he is now. He left behind his house, his last paycheck at his job, and told nobody of his intentions. We think he may be in trouble with a drug dealer or something, among other legal problems he is having. He was paying support because it was getting garnished out of his pay. Now that he is gone, he is not paying anything. What will happen when he does not show up for court next month and gets even further behind than he already is on support? Also, he has a court fine to pay in another city near here for hit-and-run. What will happen when he fails to pay that this month? Will they issue a warrant for his arrest for any of the above violations? He had his drivers license suspended for non-payment, but was given his license back at the request of the court when he started making regular payments. Now he’s gone. How will they go about finding him?

Child support stipulation question. I have to go to court.?

My sons father is in arrears of over $34,000.00. He got out of prison 6 mos. ago and still has not found a job yet. He is living in a drug rehab atm. He got thrown in prison for beating up his father. He lived with his parents who own an equestrian center. They pay him under the table and now since he is in rehab he also recieves welfare. Life is good for him right now, double tax free income.

Now he is trying to stipulate the court order to lower his payments now that he has to find a job like the rest of us.

What can I do to see that this does not happen ? I have to bring in my last two recent paycheck stubs and my last two tax returns. I also, a few years ago, found and copied a website of his stating he is a horse trainer and riding instructor on his fathers website. That specific site of his is no longer a link on his dads website. Could this help? I’m really upset that he would do this as my son and I am living in a 1 bedroom apt.

Can this work out for him?
I have not recieved a pmt for 4 years and that was $60. He has always worked for his dad under the table. In the beginning he gave me support while working for dad under the table. I suppose I could show the court this and they could consider he has been getting paid somehow. I guess he meant it when he said, ” You won’t get one shiney nickel from me”

Oh and he somehow bought back his drivers license and bought a car just a few days after getting his license. The grandparents would only give my son attention if he was a horse, they truly suck.
His court order is 370 a month most men would kill for such a low order. This order is 8 years old and I have not modified it once.

It seems drug addicted rehab people have more rights than non drug user hard working people. I would guess that his parole officer is helping him with this.

I am wondering what the legal rights are for fathers who pay child support?

The custodial parent is unemployed and an alcoholic, and demands that the father be supervised when he tries to visit, threatening him when he tries to take the child to see his grandparents, etc. It’s ridiculous, and he’s emotionally very discouraged. What are the steps he should take to make her a more responsible party? She lives with her parents and is milking him financially and emotionally. I don’t know that it is best for the child to be with her, but he is hesitant to take her to court and take the child from the mother, as well as feeling generally not up to the challenge of taking full custody. What should he do,and what role should I play as an outsider/girlfriend? I am willing but completely inexperienced with children, and I don’t want to traumatize the child but the current situation is making the father miserable and I believe the child may be suffering from things related to her alcoholism and drug abuse.

She lied- told me to trust her and remove protection-should I have to pay child support on broken contract?

In this age on consensual sex when two people get together they have a choice to use protection-I did-until she requested I remove it to prove that I trust her.I did-and now am the father of a baby I did not want could not afford. What’s worse-he was born pre-mature and was placed into incubation-when I went to see the bastard-I was confronted by Child Protective Services that told me I had to make a court appearance because she had accused me of Alcoholism and Abuse. I was told that I had to do 6 months each of psychological testing and twice a week urinalysis. I was told that she has nothing to do-can visit when she wants-and I also found that she was screwing another guy while carrying mine. In this country of contracts-when one party breaks their word they are held liable in the courts-she broke her word-trust-and confidence-endangered the babies life (caught clamedia) and I am the one the courts are holding responsible. This is UNJUST-She Verbally Agreed-I was deceived.WhyMe?

My fiance was serving a sentence for non-payment of child support.?

He is on probation currently for a felony charge and was place in a drug court program due to alcoholism. He has been in the program for two years and until we met last year he wasn’t doing so well. Anyway, he went to jail in January for child support and after 1 month of incarceration, his probation officer decided that he is going to be violated for not showing up for probation reporting days for the time that he has been in jail. What will happen?

how can i obtain child support from an ex who is on welfare and possibly in a drug rehab program .?

he is the type of person who dosen’t like to work and has only held about two jobs in his lifetime, how can i go about enforcing child support from him? we have been to court several times in the past and the only dime he has paid was when they arrested him for failure to keep a court order, but that was in nassau county, now im in the county of kings, how does this work, cant they make him get a damn job hes a lazy individual , by the way whom was not like that when i met him. and for some reason it’s always the niceness in the begining.

If I accept child support that is less than the court ordered amount does that set a precedence?

My wife’s Ex lost his job and went to drug rehab for 3 months back in 2007. He didn’t pay her child support during that time, but when he got out she verbally agreed to allow him to pay 400 a month instead of the court ordered 641.

Now, he is taking her to court to get the child support recalculated, which is fine. However, he is refusing to pay the back child support.

My question is since she agreed to let him pay 400 a month until he got back on his feet, will a court award her the back child support of the difference between the 400 and 641?
