<p><strong><i>Question by Nico</i>: What is the law for evicting someone in Indiana? Is a 30 day notice necessary if drugs were found?</strong><br />
I have a rental home in Indiana and find myself in a situation where I need to evict the current tenants.  I don&#8217;t have the lease agreement on hand today, it&#8217;s at home. So I don&#8217;t know off hand whether I made any special stipulation such as &#8220;if drugs are found on the premises you are consider in breach of the lease and will have 24 hours to vacate the premises.&#8221;  What is the time frame required by law if I don&#8217;t have something like that in the lease?</p>

<p><i>Answer by smedrik</i><br />If it is not a violation of the lease you have no grounds to evict.   This is especially if you were not supposed to be in the unit in the first place.  (Landlords legally have to give 24 hours notice prior to entering)</p>
<p>If you do in fact have grounds to evict the process takes anywhere from 30-90 days depending upon how cooperative your tenants are.</p>

Hi, I have SSI (Supplemental Security Income) and cannot work. I live with my mother but her alcoholism is starting to get on my nerves to the point of wanting to hurt her. Since there&#8217;s no law against getting drunk and sponging off of your son&#8217;s disability money, I have to move away. But I don&#8217;t make enough to get an apartment. What other choices do I have besides being homeless?</p>

<p><i>Answer by AlJo</i><br />Meth, like many drugs, can be in powder form.  </p>
<p>Drug users at concealing their habits.  Many don&#8217;t want to walk around in clubs with pipes and butane lighters or spoons and straws.  So they use things that everyone carries to get their drugs into them.  A common item is a key, any key.  They dip the key into the powder.  Some powder gets caught in the edges of the key and they snort it off the key.  Beats snorting off a dirty toilet seat.</p>

I am becoming exceedingly frustrated.  My husband has custody of his son, and his ex was ordered to pay child support.  The short story is that she has refused to do this and on 6/9 Child Support recovery took her to court for contempt, and she didn&#8217;t even show up for that.  We were told &#8220;An Arrest order in the full amount of the back child support owed will be issued&#8221;.  We asked about it more plainly and they said &#8220;We are going to lock her in jail and the only way out for her is to come up with everything that she owes you.&#8221;</p>
<p>Okay, pretty plain!!!  That was on 6/9, and there is still no warrant for her.  The Child Support Recovery office said it takes time to draw up the papers, and then get them to the judge and then back to the cops.  But how much time does this take???</p>
<p>During the summer his ex gets his son every other week.  We don&#8217;t want him at her house when the cops come to arrest her, but we can&#8217;t seem to get anyone to give us a time schedule on when this will happen.</p>
<p>Anyone out there have ANY idea???  ANY?????</p>

<p><i>Answer by PrettyPixels</i><br />I&#8217;m not in GA but here in PA to get any satisfaction out of the people at Domestic Relations (Child Support office) you need an attorney.  I have a friend without an attorney and there are constant warrants out for her ex, she even calls the police and child support office when she see&#8217;s him around town telling them the exact location where they can pick him up.  They don&#8217;t pick him up usually until she really raises a fuss, calls over and over again for weeks on end or he gets picked up by accident for doing something else and they find the warrants for the support in the system by coincidence. </p>
<p>On the other hand, I have an attorney and my ex got so far in arrears that they gave him a set amount of time to pay x amount.  He didn&#8217;t pay, I picked up my phone and called my attorney when I didn&#8217;t get the money and the following weekend he was in jail.  For some reason lawyers can make things happen around here when it comes to support enforcement. I don&#8217;t know if it&#8217;s this way in GA.  I am not the only one I know who this happens to and I am still not sure what the mechanics are behind it and why they get results.</p>
<p>I suggest calling a lawyer anyway and find out what you can do and if you can keep your child from the visits so your child isn&#8217;t exposed to a scene should she gets arrested.  You might also get some muscle behind your issue with the support as well if you have a lawyer.</p>

and didn&#8217;t go and take it (custody case) what would happen to them in court if the other party is asking for custody of the child until the drug test is taken or has anyone been through something like this before</p>

<p><i>Answer by Kelso</i><br />If there is a reason for missing the test, than there wouldn&#8217;t really be any penalizing.</p>
<p>If the person just didn&#8217;t show up to the test, than that could probably go as evidence not in their favor. Seeing as it seems that they neither care nor are they willing to take the test&#8230;..which pretty much means there is evidence of them using drugs.</p>

I am becoming exceedingly frustrated. My husband has custody of his son, and his ex was ordered to pay child support. The short story is that she has refused to do this and on 6/9 Child Support recovery took her to court for contempt, and she didn&#8217;t even show up for that. We were told &#8220;An Arrest order in the full amount of the back child support owed will be issued&#8221;. We asked about it more plainly and they said &#8220;We are going to lock her in jail and the only way out for her is to come up with everything that she owes you.&#8221;</p>
<p>Okay, pretty plain!!! That was on 6/9, and there is still no warrant for her. The Child Support Recovery office said it takes time to draw up the papers, and then get them to the judge and then back to the cops. But how much time does this take???</p>
<p>During the summer his ex gets his son every other week. We don&#8217;t want him at her house when the cops come to arrest her, but we can&#8217;t seem to get anyone to give us a time schedule on when this will happen.</p>
<p>Anyone out there have ANY idea??? ANY?????<br />
FYI, we waited a full year after we got custody to even bring her to child support recovery.  My husband could have asked for hundreds of dollars a week, and he asked for just , because she does have other kids and he didn&#8217;t want to be mean.  The custody order required child support to be awarded, and we had a hard time with the judge allowing that little.  And yes we are worried that my step son will see his mom arrested, but we gave her a year to pay child support, and she felt above it.  They suspended her drivers license and she is still above it, they asked her to go to court and explain herself, she didn&#8217;t show up.  I have no sympathy for someone who has been given every opprotunity to make things right, and just ignors all help because she thinks she is too good for it.</p>

<p><i>Answer by Chad B</i><br />Things take time, that is anything that has to do with bureaucracy does at least. I would imagine it would take anywhere from 30 to 90 days or 4 to 6 business weeks (remember, don&#8217;t count weekends!!) I would go down to the police station and ask to speak to who is in charge and explain the situation as nicelyy as possible, it is easier for someone to blow you off on the phone, but harder for them to blow you off in person&#8230;..</p>

His chances aren&#8217;t good (maybe a 30% chance) but if he survives, he can never ever drink again which will be hard for him because he would normally drink a case of beer a day.</p>
<p>Does anyone know of any good vitamins, therapies, etc. that could help? My family is just grasping at straws but I thought I&#8217;d ask.</p>

<p><i>Answer by little ace</i><br />nope hepatitis is in the liver ounce you got it you have it my mom had it hepatitis A-B, just be sure when you are around him you dont drink out of the same glass or use the same fork or spoon that he uses and be careful about who kissing him on the lips because hepatitis is very contuses especially the Sylvia and if he has a cold or if he cough a lot especially around children ask him to wear a mask and always wash your hands</p>

Do they scan debit card purchases, or does it buzz them if your I.D. gets scanned to purchase it? Or, better yet, would they find out if a pre-employment drug test turned up positive for alcohol? Do they have access to that? I&#8217;m only asking because I suspect someone I know.<br />
Thanks. I don&#8217;t know whether or not I want this person to get in trouble as we used to be friends, but had a bit of a falling out. Plus they think they can get away with anything, and that&#8217;s ridiculous.</p>

			<content:encoded><![CDATA[<p>Hello, I am going through a divorce, and my ex doesn&#8217;t want to pay child support for our two year old son. I have been faithful to him despite all of the conflict during and after our marriage, his cheating, alcoholism, and sexual abuse in various forms. I found out after our son was born he was severely abused as a child and subsequently the effects manifested negatively into our relationship. I sought counseling, but he was in the military and regular therapy was impossible. He was in prison for the past 5 months, and upon his release went to live with his mother, resume drinking and etc. after mailing me letters almost daily about his renewed faith and how we could make our family work with devotion to God in our lives. I have been hurt and disappointed by this man so much, and he is hurting us more by not providing for us as I raise our son alone so he can regress and relapse with an abusive family member. I know legally I could sue him and other means of restitution, but as a Christian it is written I should turn the other cheek. I don&#8217;t want to set myself up to be a victim by him again, but I still have hopes one day he will return, healthy and ready to be responsible and happy with a simple life. I do not know how to handle this, I feel disgusted to have divorced as it is not with my beliefs, but lost in my faith as a result. Feelings of abandonment and resentment for not understanding God&#8217;s plan for me and my son are predominant. Should I let go of the impulse to pursue justice in a legal arena? Should I let God handle it even if it seems unfair and frustrating to allow us to continue suffering financially and emotionally? My ex is predominately Native American, and I am of small decent, and 2012 is a concern for our family as well. I feel like we are falling victim to dark presence/power in our lives. Very confused, but looking to seek guidance and light. Can you help? Please don&#8217;t send negativity, thank you.<br /></p>

			<content:encoded><![CDATA[<p>Because I was once homeless myself, I am committed to helping others achieve personal growth and take an interest in their own well-being. I find that helping others is rewarding in itself and as long as I can make a positive difference in someone’s life, I will know that I have contributed to that person’s efforts to change his or her life.  As a result of my personal experience, I understand the constant despair and frustration experienced by those who find it challenging to cope with everyday life and problems. I am also convinced that increasing one’s own sense of empowerment can make the difference between a future of despondency and one filled with hope. </p>
<p>I grew up in a single parent family household with my mother, with whom I frequently had arguments. When I found out I was going to have a baby, my relationship with my mother deteriorated further. There was too much family conflict so I left. Eventually, I found myself homeless. Needless to say, being homeless was a constant struggle. Months later, I found a shelter on Skid Row in downtown Los Angeles, which was the worst part of the experience for me. Here I was- homeless, about to have a baby, with no money and no place to live. I felt alone and felt that nobody cared about my situation. At the shelter, I met a social worker, and she helped ease my concerns. I told her of my situation with my mother and she was there for me when I needed someone to talk to. She encouraged me to resolve my conflict with my mother and go back home. When I moved back home, I made a sincere effort to heal my relationship with my mother. Six months later, I found a job as a counselor, working with adolescents who have experienced similar situations to mine. I was able to save enough money to move into my first apartment. From this experience, I learned that I had the ability to persevere through my most challenging times. I developed empathy for people struggling with everyday problems, and, most of all, I learned the importance of having support from my family. Overall, social workers make a remarkable difference in overcoming life’s challenges.</p>
<p>I am applying to the Master’s in Social Work Program because it is my goal to help others to embrace their inner potential in an effort to make a positive life transition. I began my preparation to achieve my personal goal while I worked at Harbor View Adolescent Center, a level-14 group home facility, as a youth counselor. My primary work responsibility was to serve as a positive role model for adolescents 12 to 18. The adolescents had backgrounds, such as being homeless and victims of physical and sexual abuse. Others had problems with drug and alcohol abuse, depression, and the criminal justice system. At times, the position was extremely stressful but I discovered that I had the ability to connect with the adolescents and develop strong emotional ties with them. I focused on several areas of treatment, including their social skills, coping skills, and independent living skills. My main ambition was to help them to build their self-esteem and improve their sense of security.  As a youth counselor, I have gained valuable experience in listening to adolescents and helping them make positive decisions in order to improve the quality of the their lives. Overall, my career goal is to help vulnerable and oppressed individuals because I want to ensure that they have access to effective services, quality resources, and much needed guidance. </p>
<p>Most importantly, I want to become a professional social worker because I want to do everything that is within my power to enhance human well-being and help meet the needs of all people in my community, especially its most vulnerable members. This is my professional calling to do all that I can to make these people whole, empowering them so that one day many could even become be happy productive individuals.<br /></p>

<p>Client Issues, Approaches and Gaps</p>
<p>There are several issues that are facing our consumers at Mental Health Kokua.  One of the major issues is for the consumers who are suffering from such illness of schizophrenia, Bi-Polar and nomadic-depression the decline of coverage for medicine and services that were previously covered under med quest. Decline in economy has put a lot of these consumers in dire straight, where to get these services and who can they rely on to fill the gap of no medical coverage for medication.<br />
Due to changes in medical coverage many consumers are no longer able to get those services met.  Changes in med-quest deny many consumers of Mental Health Kokua the use of services that are provided at our facility.  Today they have no coverage and Mental Health Kokua is seeking to get services for the consumers in there program.  Many are still receiving basic needs meet from the agency, such as food, clothing, some sort of housing assistance and help on medication, through Kahi Holomua. Community based case manager with the help of Adult Mental Health Kokua was able to assist these client.<br />
The closing of MHK (Mental Health Kokua) homeless outreach was a major blow to the consumers who are houseless with a severe mental health issue.  Many of them used our service to get connected to a psychiatric, finding a bed for a night, assisting in getting some medical attention in regards to sores and infections.  The outreach services was the connection to reaching out to those who did not have transportation or unable to come to our door to receive mental health services.<br />
   Another is helping the consumer and some of the case managers address the issue of chemical dependency.  Many consumers with mental health issues use substance abuse in order to self-medicate themselves, when not doing to well managing there prescribed medications many consumers use substance to feel better.  The agency offers various training to the staff one is through Kahi Holomua’s, supervisor Ann Lang teaching them various techniques in identifying clients that are self-medicating themselves through alcohol or illicit drugs.  Having these classes or training is making the case manager more efficient in there attempts to help the consumer become social, and productive in there community and contribute to resilience in there own recovery.   Empowers the client to be successful in there recovery to live an independent life and manage there medication with a better understanding of the illness and not the self.<br />
Finding community activities that are culturally informative has been an issue.  Cultural can be a major issue, being that mental health has never been the norm of many cultural but the staff of Kahi Holomua does a wide variety of functions in the community that keeps the cultural aspect alive.  Many activities are based around cultural information we attend arts shows at Maui Art and Cultural Center.  Visit museums, walk around in the whaling town of Lahaina, visit the petting zoo in Haiku, and taro patches.  Many of our consumers have never been to these places or some have vivid memories of living in that area that we visit.  We also attend “Brown Bag”, it is an informative lunch event, and we bring our own lunch.  They have a wide variety of topics that are discussed at the presentation Bipolar Illness, Eating Disorder, Postpartum Depression, and Teen Suicide.  This event is open to the public, mental health consumers, and families.<br />
 In conclusion, MHK works tirelessly advocating for the client improvement, treatment and care on a daily basis with consumers with mental health issues. There maybe some gaps that I could have over looked.  MHK still reaches out to those who are at need of there services.  Dealing with the issue is only part of the problem helping the consumer is the goal of self-determination, empowering and building socialization instead of isolation.  Having the client looking at themselves and not the disorder is the focus that MHK maintains.<br /></p>
