they court ordered drug tests ive never had a record of drugs and there has never been any records of my child being neglected for her to be taken out of my home. she was supposed to remain in my custody until the results came back and she was placed with my mother before we got the results

You need to go to your states web site and laws. Unfortunately you really need an attorney. Look for the listings that have free legal help, each state should have that available. Good Luck!

If I get a restraint order on my ex, will it be harder for him to get visitation rights after our baby is born?
Im 3 months pregnant. My relationship with my ex is just NEVER going to function, trust me we’ve tried very hard. He is aggressive, violent, verbally/mentally abusive, started to show recovery of being an alcoholic but went right back, and not to mention that he’s got his priorities all messed up and has already threatened to take our child away after its born.
I want to put a restraint order primarily for my safety and of my unborn child.
Will this also help prove my case in court should he take me there? Would it be harder for him to get and rights on the baby?

Speak to someone at an abuse shelter. They will be able to direct you on your state laws and any lawyers that may be able to help you free fo charge. To answer your question in most states and in most cases yes, but nto always. Please talk to someone at an abuse shelter or abuse hotline.

I live in NY…. is there any way to object to a court ordered hair drug test??? is there any way, at all, around this? I beleive my rights may be violated………..thanks!

No. They have the right to compel it. However, they also have to have probable cause.
One basis of course is that if you’re on probation or parole, yes, they can make you submit to it.

I have a friend who has had his daughter for the last year after her mother abandoned her at his home in Minnesota. The mother has drug problems and was detained while in MN for trying to kill herself. She ended up in AZ in a rehab. The child is 8 years old and has already had 4 open heart surgeries trying to correct a problem due to drug use by the mother during the pregnancy. The mother also has a 19 year old son who was by her parents. The daughter had also been raised by the grandparents off and on whenever the mother didn’t feel like having her. K, as I will refer to the daughter, was not allowed to see her father unless he went back to a relationship with the mother, well he tried to work things out so he could be with K and the mother went to MN. She ended up leaving and had no contact with the father or K for almost the last year. The granparents also did not try to contact anyone. Last Friday the mother and grandparents went to MN and took the child while the father was working. They had the backing of the local police because the fathers name wasn’t on the birth certificate. They took her without taking any of her medications or anything. On a side note if he isn’t the father then why is Riverside County collecting court ordered child support from him? The grandparents did make a comment about her SSI money and such and it is sad that they seem to only want K for the money they can get. So if there is anyone who has any advice I can pass on it would be welcomed. The father is distraught and has no idea where they went or if he will see K again.
he does have a paternity test pending and no they were never married.

My daughter’s father and I have a court ordered custody arrangement. The father was an alcoholic and drug user, and after he completed rehab I agreed to let him have visitations. We live in different states so his family picks her up and takes her to there home hours away. We recently became on ‘good terms’ and he began telling me scary things via the phone (shooting someone up with meth, drinking alcohol, living with a guy who uses drugs, how his mother is messed up on alcohol and xanax.) I am in fear of letting my daughter go out to see him now, but I don’t have any proof as to what he is doing except for what he tells me over the phone, which makes it difficult to take him to court. He won’t say anything incriminating over text messages or on my answering machine either. What can I do to protect my daughter?

First off in my late teens I was arrested for underage drinking, posession of marijuana, and minor in possession of alcohol and as part of the sentence was ordered to undergo treatment for substance abuse. I have never been convicted of a felony and recently went to purchase a rifle in north carolina and was rejected under the NICS background check because of having been “adjudicated mentally defective”. Is there any way I can get this reversed or is there an appeal process? Worst case scenario maybe Sarah Brady can be a straw purchaser like she was for her son (jk). Seriously though what can I do when im not mentally ill?

He just got out of rehab and he’s trying to persue court ordered visitation. He has one heck of a shady divorce/family law lawyer pushing him to do it, even though he keeps repeatedly saying he is still struggling and is thinking about going back into rehab. I really don’t have money for a lawyer and need ideas about what to ask for in mediation since the ball _IS_ in my court.
Just so you know, if he were still here in state I wouldn’t have such a problem with him coming to see her and things of that nature, but he is on the east coast, and I live in the midwest. I seriously have issues with him taking her so far away!! Any ideas, anyone out there who’s been through a similar situation??
BTW, my ex is pretty impressionable as far as what I say to him buy his lawyer always seems to smooth him over. If he takes me to mediation I really want to make it hard for him.

The custodial parent is unemployed and an alcoholic, and demands that the father be supervised when he tries to visit, threatening him when he tries to take the child to see his grandparents, etc. It’s ridiculous, and he’s emotionally very discouraged. What are the steps he should take to make her a more responsible party? She lives with her parents and is milking him financially and emotionally. I don’t know that it is best for the child to be with her, but he is hesitant to take her to court and take the child from the mother, as well as feeling generally not up to the challenge of taking full custody. What should he do,and what role should I play as an outsider/girlfriend? I am willing but completely inexperienced with children, and I don’t want to traumatize the child but the current situation is making the father miserable and I believe the child may be suffering from things related to her alcoholism and drug abuse.

Well here goes. I have been married 4 years in June. Out of those 4 years I deployed 25 months all together. Over both deployments she moved back to Oklahoma with our two children. It was both of our decision as was both our decision for her not to have employment, due to costs of childcare. We agreed on this. I always told her it was her decision. After my first deployment, I came home, and got into it with alcohol. I seeked help from a military source. Our marraige was steadily in turmoil due to her abusive and destructive temper tantrums and rage issues. After I deployed again, it became obvious to me as well as our friends and family, that she was going to go to the bars, drink, and party every chance she got. That caused countless problems and fights when I would call home to find she was out and the kids was with a sitter. I was furious, it was almost nightly. Then rumors of infidelity arose. I was being told by numerous sources both trusted and a little shady, that she had been permiscuous, and had cheated on more than one occasion. With 14 months of me trying to tell her that it is excessive and that a wife and mother should not behave this way, I lost all trust in her. Almost every conversation was about who she was with and what she was doing. Upon my redeployment home, the home became a house full of eggshells. I couldnt hardly talk to her without her blowing up on me and fighting about everything. She drank, and fights would become physical. She has been witnessed by friends and family of the outbreaks of rage and her destructive behavior. One night it became severe. We fought, she threw punches, and held her down, and tried to just get my things and leave. She followed me out the door with a knife. I disarmed her called the cops, and she was charged with 4 degree domestic assault. They left the knife out of the police report because I didnt want her charged with a felony. I bailed her out, we talked and came to the conclusion to get counseling. We argued a little here and there but not so bad. She had been ordered to take domestic violence classes, and had probation for 2 years. A close friend of hers died back in OK, so naturally she wanted to go back to the funeral. We have one vehicle, so I coordinated to get a ride to work until the end of the week. Her and the kids went back to OK. A day later in she allowed her anger to resurface and got into an altercation with her 17 year old sister in law. She was arrested and charged with domestic assault, in which she has pleaded not guilty. I was furious. I was left without a vehicle and my stepson was missing school. I told her I was coming to get the car and the kids. She agreed to allow my stepson to come back with me, along with our daughter. That was on march 16th. She has been bar hopping, doing drugs, and yet some more rumors of infidelity have surfaced. there has not been a conversation on the phone we have not fought and threatened divorce. I have had the kids on my own, in the military, a 5 yr old stepson, and 2 year old daughter. She has missed her court date here, as well as her classes. She has a warrant out for failure to appear, and violating her probation. Her court date in OK is July 8th. Well I have recently had been talking to a counselor that has talked about me having PTSD. Not a severe case, although in a divorce case she plans to use my PTSD(unconfirmed), distrust, and alcoholism(first deployment) as grounds for getting everything, the kids the car alimony and all that. I cant afford an attorney unless the are pro bono and the military laywers dont help with divorces. I dont know what to do!!!! I need answers…

im a person living w/cancer. My meds makes me sick and nausea so i was self medicating myself with marijuana. then i got into a lil trouble with the law,had to drop urine but of corse it was dirty.The judge looked at my fileand yelled my head off about something she didn’t know. “There is no such thing as medical marijuana in the state of Ohio” she said. she ordered me to probation and drug rehab. Iwent to glenbeigh because i didn’t want to go to jail for PV. i talked to somebody there and they sent the info to my probation off.Saying i could stay as long as my dr.didnt put me on meds that contain THC.remind you i didnt get this letter. I go to the dr.during all of this,and told my dr.the problems i was having with the meds.He prescribes Marinol (THC) pills.NOw im taking my meds wiyhout the sickness and everything is going smoothly. Know my probation off. is on my back because Glenbeigh sent her this letter, and she wants me to see if my dr. will change my meds. do i need a lawyer?
the probation officer knows that she’ll be crossing the line,thats why she wants me to take this letter from glenbeigh that was addressed to her and let my doctor see it a try to get me on something else.which im not going to do because i think i have the right to stay on the meds my dr. prescribed. And if i tell her im not going to do that. Would that be considered as violating my pobation?
What are my rights when returning to work after disability?

I have been on disability and I have not worked for some time. As I start looking for work, employers tell me I am automatically not qualified because I do not have any recent experience. I had a trauma injury and I have worked very hard in Physical Therapy to improve myself. Can Employers disqualify me on that basis alone? Is there anything I can do? I am working with the Department of Vocational Rehabilitation also. Isn’t this against the Americans with Disabilities Act? How can anyone on disability go back to work if they are automatically disqualified for not having recent experience. It says clearly on the job requirements that you have to have recent experience.
Any thoughts? THANK YOU!
