<p><strong><i>Question by iluvthePhillies</i>: Why doesn&#8217;t the 5th Amendment give criminals the right to refuse to submit to a court-ordered drug test?</strong><br />
For those of you who don&#8217;t understand my question, HERE ARE THE FACTS:<br />
1. The 5th Amendment says that &#8220;no person shall be compelled in any criminal case to be a witness against himself&#8221;, which is another way of saying &#8220;you have the right to not incriminate yourself&#8221;<br />
2. Anybody who submits to a drug test is committing an act of self-incrimination<br />
3. The Exclusionary Rule states that evidence obtained by illegal or unconstitutional means cannot be used against the suspect in question<br />
Therefore, we can safely assume that any criminal who is asked to submit to a drug test can say &#8220;I plea the 5th Amendment&#8221; and refuse to submit to a drug test.  We can also assume that if the authorities drug test someone by force, they cannot use a positive test against the suspect cuz doing so would violate the suspect&#8217;s 5th Amendment rights and as such ALSO violates the Exlusionary Rule.  It all seems perfectly straightforward and simple, but clearly this is not the case cuz people who refuse a drug test automatically get arrested.  Can someone explain to me why the 5th Amendment doesn&#8217;t give ppl the right to refuse to take a urine test or any other type of drug test?</p>

<p><i>Answer by |[Sacred]|</i><br />Because you are not testifying. You have evidence that needs proof. It&#8217;s like a DNA test in a murder trial. You don&#8217;t have to testify but you do give a DNA sample for proof.</p>

I know those two things are required before going to court. My father is an alcoholic and my mother is a convicted felon who has left my family 3 times. My parents have always neglected me and cant even make it without the assistance  of my grandparents. Is there anyway my case could hold up in court? If so is there anyway I could just get a portion of my grandparents money back for them?<br /></p>

However my concern/problem is that their dad works away or has courses to do with work or at the moment is in rehab for the last 3 weeks and is no where around when my kids go to their place. They don&#8217;t see him and they talk to him on the phone very seldom. It bugs me, hurts me, and I feel is taken away my time I can have with my own children to bond, play, do homework etc. Do I have to let my kids go their when he&#8217;s not there? Do I have that legal say? Their father is not around for his parental time which is giving to him. He&#8217;s got the parental time not her. They are married however. Its good that she may want to be involved with my kids nothing wrong with that when their dad is around. When he is not why cant they stay with their own mom who has been stable, sane, and whom they have been raised mainly with?  My children boy and girl  like to go there for the simple fact that she has son they play with. Its always about him. Not her. I don&#8217;t know what to do. What kind of person keeps someone else&#8217;s kids from their mother and their father is not there to spend time with them? I need advice that is in reference to Alberta Laws<br /></p>

			<content:encoded><![CDATA[<p>She gave birth to her 3rd child last week, and she has been court ordered not to have any type of contact with her other two children because she is a crack addict and an alcoholic.  In her 8th month of pregnancy, we had found out she was smoking crack and drinking while she was pregnant.  Me and my other sister gave her the choice to either commit herself to treatment, or we would commit her ourselves.  She has been in and out of rehab for a couple of years and has been smoking crack for years.  We have contacted all the proper authorities and nothing was done.  She was allowed to leave the hospital with that baby.  My family and I will have no contact with her at all.  She was supposed to go into sober housing after she had the baby, and instead moved to a bad side of town in an over crowded apt.  It is hard not to see the baby, but we are hoping she will be taken from her.  Are we doing the right thing?<br /></p>

			<content:encoded><![CDATA[<p>My 9 year old cousin (Drake) is currently living with my husband and I. His Mother (she&#8217;s my cousin to) is back in rehab for her crack cocaine addiction she was court ordered to give Drake up. His Father was shot and killed 4 years ago. The only other option was he either came to live with me or he went into foster care and I didn&#8217;t want him to go into foster care so I took him in. I&#8217;m only 24 years old and my husband is 29. No one else in my family would take my cousin because he&#8217;s known to get out of hand at times and to be honest, I really don&#8217;t think they care what happens to him.</p>
<p>I need some advice on a couple of things&#8230;. Every night before bed I get all of Drakes stuff together for school the next day. I put $4.00 in an envelope in his backpack for lunch. I leave at 5 am during the week for work and my husband puts Drake on the bus. I was doing laundry last night and I found $85 in Drakes pants. I asked him where he got the money from and he said his friend told him he could have it. I didn&#8217;t say anything else and when he went to bed I asked my husband what he thought about it and he said that he gives Drake $5.00 everyday for lunch because Drake asks him for lunch money. I told my husband that I already give him money. I&#8217;m assuming that this is the money he&#8217;s been making off of my husband so I took it. I have not spent it but I&#8217;m not going to give it back to him due to the fact that he&#8217;s been lying about needing money. I have also decided to start making him lunches so he doesn&#8217;t need money during the day. This is not the first time he has lied to us. He stole some of my fake jewelry about a month ago and sold it to another kid at the park. I got it back but he lied about the whole thing.</p>
<p>I received a phone call at work today and Drake allegedly touched a girls private area while playing and then proceeded to punch her in the face when she wouldn&#8217;t play along. He&#8217;s being suspended for 10 days starting tomorrow. I spoke to the school psychologist and he said Drake needs counseling for everything he&#8217;s been through. I agree but we already tried going to counseling and he was literally mute at every visit. How on earth do I handle this? Where do I go? Who do I talk to?</p>

I have not spent it but I&#8217;m not going to give it back to him due to the fact that he&#8217;s been lying about needing money. I have also decided to start making him lunches so he doesn&#8217;t need money during the day. This is not the first time he has lied to us. He stole some of my fake jewelry about a month ago and sold it to another kid at the park. I got it back but he lied about the whole thing.</p>
<p>I received a phone call at work today and Drake allegedly touched a girls private area while playing and then proceeded to punch her in the face when she wouldn&#8217;t play along. He&#8217;s being suspended for 10 days starting tomorrow. I spoke to the school psychologist and he said Drake needs counseling for everything he&#8217;s been through. I agree but we already tried going to counseling and he was literally mute at every visit. How on earth do I handle this? Where do I go? Who do I talk to?</p>

			<content:encoded><![CDATA[<p>My 9 year old cousin (Drake) is currently living with my husband and I. His Mother (she&#8217;s my cousin to) is back in rehab for her crack cocaine addiction she was court ordered to give Drake up. His Father was shot and killed 4 years ago. The only other option was he either came to live with me or he went into foster care and I didn&#8217;t want him to go into foster care so I took him in. I&#8217;m only 24 years old and my husband is 29. No one else in my family would take my cousin because he&#8217;s known to get out of hand at times and to be honest, I really don&#8217;t think they care what happens to him.</p>
<p>I need some advice on a couple of things&#8230;. Every night before bed I get all of Drakes stuff together for school the next day. I put $4.00 in an envelope in his backpack for lunch. I leave at 5 am during the week for work and my husband puts Drake on the bus. I was doing laundry last night and I found $85 in Drakes pants. I asked him where he got the money from and he said his friend told him he could have it. I didn&#8217;t say anything else and when he went to bed I asked my husband what he thought about it and he said that he gives Drake $5.00 everyday for lunch because Drake asks him for lunch money. I told my husband that I already give him money. I&#8217;m assuming that this is the money he&#8217;s been making off of my husband so I took it. 			<content:encoded><![CDATA[<p>My brother in law and my sister (lets call them Bre and Ken) are EXTREMELY addicted to pain pills. They get methadone, legally, but they take way more then the reccomended dose and Ken keeps them at all times, even though they are Bre&#8217;s Meds!! He sells, trades, and gives them away! (they both go through heroin-like withdrawls without their meds) They both are also heavy weed smokers, which im not against, they just put weed before anything, including food for their two children (one 3 year old and one 6 year old *girls*)&#8230;.. They recently started buying Extacy to substitute for when they have pain pill shortages, which is A LOT! And they have also been drinking to substitute for it too!! So they are now alchoholics, big time. They have 5 teenage boys living in their house and a teenage girl, so that means parties all the time. </p>
<p>And the sex has gotten out of control. Ken will have sex with guys and girls, including Bre, having orgies.. like 10 people having sex while messed up. Ken recently tried to kill himself while on alcohol. And he hit Bre.. And uses his Druggy Excuses like he it will never happen again because he took Anabuse (which only lasts 72 hours)<br />
Triple C&#8217;s are also very popular at that house. The teenagers are mostly the ones who do it, but when its a last resort, ken and Bre do them too. Its COLD MEDICINE!!</p>
<p>I think its so sad that their kids are actuallly used to seeing their daddy kissing other guys, fighting, their dad almost killing himself, not knowing what their parents are like off drugs, watching them die slowly&#8230; </p>
<p>They often talk about how mommy and daddy need their medicine so they wont get sick and mad. Watching their parents fall asleep with cigarettes in their hands and not being able to wake them up&#8230;</p>
<p>Im so scared, and i want to make an anonymous call to someone who will go over there and take them to rehab or have them court ordered to it!!<br />
im scared about their safety and my neice&#8217;s</p>

			<content:encoded><![CDATA[<p>I have been court ordered to give visitations to my children&#8217;s father.  He is a recovering addict.  (Hooked to drugs) He is currently in a half-way house to sober up for the time being.  This is his 4th trip to a rehab type program.</p>
<p>I have reason to believe from my daughters mouth that he has touched her.<br />
He doesn&#8217;t plan his visitations until the day before visitation so I can&#8217;t plan anything for my day until the day of.<br />
He has made me late for work 3 times for not showing up on time for pick up.<br />
He has a violent past against me.  I have a restraining order against him.<br />
According to the parenting guidelines in my state he is legally suppose to give me his address and refuses to.<br />
He has taken the kids over to a womans house that we both know has done and sold drugs before.<br />
(His brother took them over there today)<br />
He was suppose to take the kids to church to observe Easter Sunday and did not take them as he promised he would.<br />
He has also admitted that he calls the kids for an excuse to talk to me.<br />
I have spoken with an attorney and he said I could stop visitations but i could get caught with contempt although every thing I have it should get thrown out.  </p>
<p>I am trying to protect my kids and the courts here aren&#8217;t helping.<br /></p>

			<content:encoded><![CDATA[<p>The guy can&#8217;t call anyone because everyone has that block so you can&#8217;t call collect.  He is in jail for petty theft.  It was really dumb on his part because he knew that his girlfriend could be having his baby anytime.  It was 2-weeks early and unfortunately, his court date was tomorrow and they probably would have let him out.<br />
ANYWAYS!  I called the jail (it&#8217;s a small jail) and talked to a nice jailer and she told me that she&#8217;d relay the message that his little boy was born around midnight last night and is doing just fine!  It&#8217;s his first baby.  They are both friends of mine.  I just hope that maybe this will be a MAJOR WAKE-UP CALL to him!  Hopefully, someone taped it.  I guess her mom and dad were with her.  He does have a drug addiction (that&#8217;s why he stole).  When I first met him, he was totally different.  I think she should give him an ultimatum and if he won&#8217;t get help then get a restraining order but she LOVES him too much.  She&#8217;s the prettiest, sweetest girl and she just turned 21.  He&#8217;s going to be 29 and he&#8217;s tried to corrupt her.  Maybe I&#8217;ll get some &#8220;MYOB&#8221; but I see myself in this girl 15 years ago (I&#8217;m 36).  I was very pretty, had tons going for me, had very supportive parents, had everything I could want but I threw it away for drugs.<br /></p>

My very own mother, who is a drug addict and has many mental health issues such as Bipolar Disorder, Manic Depression, Schizophrenia with Psychotic Episodes as well as does the man that she married 2 years ago that she met in a Psychiatric Hospital and only knew for 3 weeks before she married him, took custody of my girls from me. My ex husband stabbed me 4 times in the face and neck 2 days after Christmas and left me for dead. Luckily I survived. I took my girls and went to live with my mom because I had no where else to go and she told me she was going to help me. I was having a very hard time sleeping at night because of the nightmares and I was having panic attacks. My mom started giving me xanax to help me sleep and stay calm. Out of nowhere, my mom went to the DHS and made up a bunch of lies and told them I was all strung out on drugs which was not true. I asked for a drug test and they refused to give me one. When we went to court, the judge would not even let me speak the first word or defend myself. I didn&#8217;t have an attorney. I had no clue that she had made up so many horrible lies on me and all the while she was on drugs herself. My mom was issued temporary emergency custody of my girls. I was ordered to do a drug program. I had a full time job and I asked if I could do outpatient and I was told no. When I finally got the court order 6 months later, it said impatient was preferred not ordered. So I couldn&#8217;t complete an impatient program because I had a home, a car, and I still financially supported my girls. The company I worked for went out of business in May and I immediately began a new job. That job ended in September and I immediately began another job. When I went back to court in October, my mother gave custody to my ex husbands great grandmother and great aunt. They ordered me to have no contact with my girls and I dint understand why. In court, they jumped my case saying I should have done outpatient and I tried to explain to the judge that I called and asked my caseworker and she told me that it was unacceptable. Its a messed up court system. I wasn&#8217;t even allowed to speak in court. I tried to speak one time and I was told that if I spoke again I would be held in contempt of court. So all I could do was remain quiet while my so called mother sat right beside me and lied on me. The judge told me I had to quit my job and the only thing I was to do now was go to rehab. Well, I quit my job. I am on a waiting list to get into a rehab that I found that would take me without insurance. I have at least 4 more weeks left on the waiting list. I go to court in March and I know his family is going to fight me for full custody. I dint know what to do. I am by far not a bad mom. I have never so much as spanked my kids ever. I have taken care of them by myself while being in a very abusive relationship with their father. I ha vent spoken to or seen my girls in 2 months today and Im about to lose my mind. My girls love their Mommy and they cry to be with me. They carried them out of the courtroom crying that they want their Mommy and they love their Mommy and she is not a bad person. Its killing me to know that they want me so bad and I cant do anything about it. No one has even explained to my babies why Im not there.  They have no clue what is going on.  Its so unfair!!!!!!  I don&#8217;t understand how this could happen when they had no evidence against me. All they had was my moms word and she is legally crazy!! I cant afford an attorney now because the judge ordered me to quit my job till I go to rehab. I need an attorney to represent me in court in March or I could possibly lose custody of my girls for good and for no reason at all. Can anyone help me with this situation?? All I want is my babies back so we can go back to being a family like we were before my husband tried to kill me.  I love my babies with all of my heart and would never put them in harms way and they will tell you that themselves.  What do I do before I do lose my mind??<br /></p>

<p>When a family member of his complained, they was told the young man had given up his religious freedom when he &#8220;signed up&#8221; for the program.</p>
<p>  By the way, this man rec&#8217;d no actual drug re-hab services, the whole program was centered upon destroying his religious convictions.</p>
<p>  Should our court system be facilitating these type of &#8220;drug rehab&#8221; programs in any way, shape or form.<br />
Excuse me, I should have said he was told he could AVOID jail if he went to re-hab.</p>

Yes, magiepix, I avoided letting people know right away that this was one Christian group denying a Christian of another denomination the right to worship.</p>
<p>  Yes, as a Catholic he WAS denied the right to worship, and was also told that his religion was witchcraft.  I have read several stories about this over the years.</p>
<p>   I am sure that when he agreed to go into a &#8220;christian&#8221; based re-hab, that he was NOT informed that this &#8220;Christian&#8221; based &#8220;re-hab&#8221; was rabidly ANTI -CATHOLIC. </p>
<p> And this was not a &#8220;drug re-hab&#8221; program, it was a pure and simple religious indocrination boot camp.<br />

<p>If I had a problem with alcohol as much as I had with tobacco, I&#8217;d be court ordered to rehab based on health reasons and public opinion, a danger to myself and others. A majority of the public is saying no to cigarettes. While at the same time the tobacco companies won&#8217;t give out any signifigant information on how second hand smoke effects other people.<br />
Yay! Great, you pay your medical bills. What about the people who don&#8217;t? Does that make them exempt from smoking? Freedom is not free!<br /></p>
