Question by You know me, I’m your friend: I have a question about the manufacturing meth laws back in the 1990s/early 2000s?
Were the consequences for manufacturing meth a lot less severe back in those days compared to now? I often wonder cause I remember seeing a lot of rolling meth labs on COPS back in the old days

Not really, while some states have increase the penalties the reason you don’t see them as often now is because the raw ingredients were a lot easier to come by back then.

Question About My Son?

My son is 12yrs old and when i busted my back he went to live with his nana and papa until i got better, well my recovery took 18months and in that time they(grandparents) convinced themselves they were his parents so i had to actually take them to court to get my son back which took a whole year because of the jammed up court system.
To make a long story short my 12yr old was diagnosed as having depression as a result of family issues. We were told that his grandparents ,myself and my husband should go with my son to his counseling sessions in order to help him, but his grandparents say they shouldn’t have to and while he was living with them he was great and that they do no wrong and his depression is purely my fault. Now as his mother i openly admit that when he was a baby i was a bad mother i had no help and he was my first child and i knew nothing of raising kids. I never drank or did drugs i just did things poorly like i would wait 4 or 5 hrs before changing his diaper but only cause i didn’t know any differently. Should his grandparents come to the counseling or am i purely responsible for my son being depressed?
this is my husbands account. I should also note that up until 4months ago my sons grandfather was showering with my son and he felt there was nothing wrong with that and yet we never knew it was happening until my son told us and we put an end to that very quickly, so do you think maybe his grandfather doesn’t want to do the counseling session in fear that something might come out about him possibly molesting my son?
his grandfather said that my son told him he was afraid of me and that he was afraid to contradict me and i told him so what i am his mother, his parent and he can contradict me and question me when he is 18 but not until then and i should add that his biological father is not in the picture and never has been and the grandfather is such a good parent that his own daughter had 2 kids by the time she was 18.

The grandparents sound like nutjobs, and even if you’re not a perfect parent, you don’t sound terrible. They should go, but they sound crazy anyways so maybe it wouldn’t help. No one is responsible for his depression, depression just happens sometimes. Good luck.

Well long story short, six months ago i was caught with marijuana and the charge was reduced to disorderly conduct. A few days ago i received a letter in the mail saying i must take a drug evaluation thing and am scheduled to do so in a couple days. i WILL fail the urine test. My question is if this test shows up that i have used mary j (basically tested positive) what is going to happen?
Also, will this disorderly conduct hinder my ability to get into med school and keep a very professional career? (I was caught when i was 17, i am now 18)

Well it depends, they can either disregard it completely or make you attend a period of once a week classes on marijuana and other drugs and take drug tests for like 3 months. it just depends on who the judge is and shit.

Question regarding the release of medical information, in the case of a psychotic drug user?

Dr. Jones runs a rehab facilitly and is treating a psychotic drug user. The patient suddenly abandons the facility leaving a note that he plans to kill his ex-wife today. The patient has left behind his antipsychotic medicine that he must take every two hours. Dr. Jones

A. may not release this information because it’s confidential.
B. may release the information
C. may release the information only if the patient authorized such release in advance.
D. may release the information after obtaining a court order first.

These answers do not make sense to me. If the patient does harm his ex-wife, the ex-wife could sue Dr. Bob for failure to warn. So is warning the ex-wife considered “releasing the information”?

Defamation of Character Question?

I work in drug and alcohol counseling services as part of county human services. One of my duties is to assist with aftercare for the county jail. We have a religous based outreach group in our area which does work in the jail as well with ex-inmate. A new client of mine asked if she could continue her counseling (mandated by parole) with one of the leaders of this group (no formal education or licensure, not an actual counseling practice). The next week she came back saying that because she was not able to make one of the bible studies because of child care issues this individual went to my client’s parole officer and employer stating that she had relapsed, when in fact she did not. I did some checking up and this org has some fairly extremist attitudes. Would this be a valid defamation issue, no one is looking at prosecuting but I would like her to have something to hold over this individual’s head incase it happens again.
For the record I have tested her myself (not that this is definitive), as well as already contacted her parole officer.

Thank you all for the input so far, but please limit this to issues of legal applicability; “defamation, slander, opinion, etc?” I do not need assistance on how to do my job, just a informal legal opinion.

Here is a heavy question for saturday morning, please read and help, everything is so messed up?

I’m going to try to shorten this as much as possible and still get all the relevant information in. When I was 10 my parents got married and my mom married a guy named Eric who was abusive and did drugs. For four years I lived with them and watched him beat my mom up and sometimes rape her. They were both drunk most of the time (or on coke) and would disappear for days at a time, leaving me home alone with my two little brothers, who were born when I was 12 and 14. I missed a lot of school watching my little brothers, and was very depressed because my home was a hellhole.

At 14 my dad got court ordered custody of me and I had to go live with him. He had been trying this whole time – and I saw him a lot those 4 years, but I was stubborn in staying so I could protect my mom, my brothers and my dog. (I had long since smuggled my cat to my dad’s apartment to protect him from my stepdad.) When I moved in with my dad I took my dog, but there wasn’t anything I could do for my mom and my brothers, and eventually there was even a third brother. Through all this time my mom and stepdad would go on binges, they would get people to watch the kids and then disappear for days at a time, they slept around on each other and it was always violent and chaotic there. I visited less and less even though I felt bad, because I was terrified of Eric and so angry and disappointed that my mom kept choosing this guy over her kids.

Eventually Eric got sent to prison, my mom disappeared and the kids got sent to foster care. The kids ended up with family in new jersey and 5 months after she disappeared my mom contacted me from a women’s rehab center where she had been attempting to get over her drug habits. She came back, got a job and apartment and without eric she was doing okay. Nearly 10 months after she had left she got the kids back and she was doing really well. That was 3 years ago, and she has been struggling with depression and falling back occasionally but for the most part has been okay. Whenever I hear from her it is always to help her with a problem, or to give her money. (Being stupid at first I gave her cash, now I realize that when she needs money for a bill or needs food to pay the bill myself or bring her shopping or the money goes to cigarettes and booze). She would have strange men over, have violent relationships and constantly used people.

I have a lot of anger built up, because she was never there for me when I really needed a mom. You know, never taught me to shave my legs or put on makeup, and I don’t want to get into the embarrassing shopping trips with my dad for girl stuff. It was more than that too, because I hated her for choosing someone that hurt her over her kids, but I still have never been able to express this anger because she breaks down, and I’ve had to be the strong one even though she was the parent.

Well, 3 months ago my stepdad got out of prison… and my mom let him right back in her life. Everyone believed that he had changed, but of course they hadn’t lived with him and seen the same act over and over. I tried to support my mom, but we kind of distanced ourselves because I did not want to see my stepdad and I was disappointed in her for letting him back in her life when she was doing so well. It only took him a month to get back on cocaine and to get her on it to. Only a month to start beating her again and for them to go on binges and stick people home and try to con money out of her family. A month ago she called me and told me that she needed money to pay the electric bill because my little brothers couldn’t be in the dark (she uses them to guilt me a lot) and I agreed to pay it and asked where to send the check. She told me it had to be in cash and that she had to deliver it, so I had to give it to her. I was disgusted that she was trying to con me out of money, since I have always given her the money she needs and helped pay her bills, and hadn’t talked to her again.

I had a very bad feeling this week and tried to call her a couple times a day, but haven’t been able to get an answer. I finally went to her house and no one was there and her apartment had been evicted. I panicked and called my grandma and she said that 4 days ago Eric violated his parole and was sent back to finish his prison term. My mom went off the deep end and got really drunk or high and ended up getting committed and the kids went to a friend of hers until DSS can figure out what to do with custody.

This isn’t the first time, and I’m 23 now, and the last 13 years have been about me helping my mom and fixing things when they go bad and I just… I have to call her, and I don’t know what to say. I can’t tell her things are alright, because they aren’t. I can’t tell her when she gets out that I’ll speak for her at DSS to get the kids back, because they have been bounced around so many times she has already ruined their lives, I think they would be better off somewhere else. I can’t tell her I’ll fix it because I love my mom but how many times can you pick someone up if they don’t even try to stand? She is my mom but… I have no faith in her, even if we get her through this Eric gets out in October and I know she will take him back and we will go through this again and again until she manages to completely destroy everyone around her.

I have to separate my little brothers and her, because they deserve my help but I’m not really sure if she does anymore. I contacted her friend and talked to the boys, they are okay, and I gave her friend some money to help with the bills but I feel so… empty about her. I want to take care of her and the boys, but she has taken advantage of and hurt everyone that has ever tried to help her, what do I do?
The boys are 10, 8 and 6.

Criminal Justice Question?

Ok, this may be a bit long, but thanks for all who read. I had a dui in 2006, I was ordered to pay some fines, and pay for a 3-day alcohol treatment. I never finished paying the fines, and a warrant was put out for my arrest. Fast forward to 2009. My boyfriend received a kidney after waiting for 5 years on the list. I was driving him home from hospital, and was stopped for a “loud exhaust”. After running me I was taking into the station, without cuffs, no rights were read to me. They were nice enough to not call the county of my warrant, but refused to call the ambulance for helping my boyfriend( who had no pain medication), saying it was out of their jurisdiction! I was finally bailed out, and we had to stop at an er on the way home, because my bf was in so much pain. The next day he was life-flighted back to cleveland clinic, with two mini strokes. He is still there recooperating now. My question to you is do you think the courts will see it as justified why I drove? They asked if there was someone else, and there really wasn’t. His parents bailed me out from Texas, and called relatives of his that I didn’t even know how to get a hold of. Plus it took them about 4 hours to get there. We have a child together, do you think that makes a difference? They have already impacted his health, which in my mind, they had a right to help him, since they are supposed to be public servants. Now that he is in hospital, the impound will be so much, we will never get our car back, just wondering what to do??? Oh my warrant in the other county wont be valid on court date, made payment, and will be on payment plan, so that shouldn’t be an issue here. Thanks for everyone who answers. If it matters, I am in Ohio, and it was the Brecksville police, they have about a 1 mile drag of highway in their jurisdiction, that they like to abuse their powers.
I am not saying we don’t have friends, just not good enough friends that were available at that time. We are on a fixed income, paying a taxi to take us home 100 miles was out of the question.
I think people are misunderstanding the question. I know i procrastinated on my warrants, but when i go to court the warrant wont be there. So my only charge will be driving with loud exhaust and driving under suspension. Really wondering if I will get leniency for the driving under suspension under the circumstances.

Protesting / picketing at a court house question?

After 18 months in a custody dispute, our judge determined that even though during this lawsuits time frame, my son’s mother has been arrested 2 times for cocaine possession and also received a DUI with our child in the vehicle. that he would not grant me temporary custody of our child until my ex wife under went rehab.. and at that time I would be more than willing to divide the custody jointly when he was able to care for our child.

This is just a brief description of how our divorce came about, and how we ended up in court.. but if I grabbed a picket sign and sat outside the courthouse (just myself) would I be arrested. I appealed, but this is some kind of joke. There was no rehab ordered for her or anything. Just a psychological exam that she failed miserably.

I want to get her the help she needs. I even offered to pay for it although we are separated. I was denied and our child still remains with her.

Would I be arrested if I did a one man protest outside the court house?

A question about addiction treatment…?

I was just wondering whether there are statistics that show facts on whether persons who had spent their time in jail and gotten addiction treatment were really better off when they got out of jail than those who did not undergo addiction treatment.

NJ Country Jail – insurance question?

If we go to jail for 90 and then they allow us to spend the additional 90 days in a 90 days in an inpatient alcoholism treatment program, do we have to pay the cost?

My insurance for the military is about to run out and I haven’t been to my last court date yet…its been postponed and I’m really nervous I’m going to have to stay in jail for the full 180 days and watch all the growing I’ve done in the last two years go straight down the drain.

any information on Gloucester country jail or what to expect regarding my third dui would be great.

It happened about two years ago and they postponed it (put it on hold) so that I could go to Iraq and now upon my return im going straight to jail.

Talk about a punishment and a half.

First time in my life I’ve got it together and now im about to lose it all.

I know it’s my own fault and I take responsibility for it but I can’t tell you how many times a day I just don’t even want to see what day two holds for me. I single handedly destroyed the rest of my life.

Does anyone also know if VA covers this type of cost.

Question about relatives IN-DENIAL about their drug/alcohol problem?

I have a relative who thinks his drinking/weed smoking is ok. WELL, maybe so; but, he was arrested and has to go to court-ordered classes. He keeps testing dirty for weed and they are threatening him with JAIL and/or in-patient treatment.
QUESTION: If he didn’t have a problem, couldn’t he have PUT ALL THAT DOWN until he finished his court case?
the arrest was for possession during a traffic stop.

Child support stipulation question. I have to go to court.?

My sons father is in arrears of over $34,000.00. He got out of prison 6 mos. ago and still has not found a job yet. He is living in a drug rehab atm. He got thrown in prison for beating up his father. He lived with his parents who own an equestrian center. They pay him under the table and now since he is in rehab he also recieves welfare. Life is good for him right now, double tax free income.

Now he is trying to stipulate the court order to lower his payments now that he has to find a job like the rest of us.

What can I do to see that this does not happen ? I have to bring in my last two recent paycheck stubs and my last two tax returns. I also, a few years ago, found and copied a website of his stating he is a horse trainer and riding instructor on his fathers website. That specific site of his is no longer a link on his dads website. Could this help? I’m really upset that he would do this as my son and I am living in a 1 bedroom apt.

Can this work out for him?
I have not recieved a pmt for 4 years and that was $60. He has always worked for his dad under the table. In the beginning he gave me support while working for dad under the table. I suppose I could show the court this and they could consider he has been getting paid somehow. I guess he meant it when he said, ” You won’t get one shiney nickel from me”

Oh and he somehow bought back his drivers license and bought a car just a few days after getting his license. The grandparents would only give my son attention if he was a horse, they truly suck.
His court order is 370 a month most men would kill for such a low order. This order is 8 years old and I have not modified it once.

It seems drug addicted rehab people have more rights than non drug user hard working people. I would guess that his parole officer is helping him with this.

Family Court Question?

in a nutshell my sister and her husband are going to family court for a divorce/ custody of there son.now the reason for the divorce was he was abusing her and just an all around A**hole.my sister thinks because of the fact he hit her she is in the clear for custody. only thing is she is addicted to pain pills/ anxiety pills. My mom wants to write a note to the judge asking him to place her in court ordered rehab and if possible maybe my parents get him till she completes rehab. my question is can this work? do you think the father would get the son if my mom does this? etc..its a very messed up situation but my sister needs help.
he has never hit the child but he has Da’s all over him wanting him in jail…AND he does the pills also. as far as proof she was beat, YES everytime he hit her and left marks i took pictures of her while holding a news paper with the date. we have ALOT of pictures.

Small Claims Court question.?

My sister submitted my story of alcoholism to the show INTERVENTION. They chose me, lied and said they were doing a student documentary, taped my personal life for a week, did the intervention with my family & I agreed to go to rehab in Flordia for 3 months. I sucessfully completed rehab & moved back to my L.A. Calif home clean & sober only to find they had cleaned out my apartment & moved ALL of my things to Florida because they do not want me to live in LA anymore. I have requested my sister to deliver my belongings to me but she wants me to pay. Can I take her to small claims court? This is a huge expense for me right now as I am on the verge of trying to rebuild my life sober. Oh, she is not satisfied at all by the way that I have completed the program sucessfully. She just wanted me back in florida where she lives- that was obviously her main objective. This doesnt seem fair. She has my clothes, computer, camera equip, guitars, EVERYTHING. Do I file small claims in LA or Florida?

Child Custody/Visitation Question – California?

My husband is 40 and he has two sons (12 & 9) with his ex. They had joint legal custody and he had full physical custody until last December. She is a long time prescription drug addict and overdosed in December. We went to court and got full custody and stayed the visitation. Since then the DA has filed criminal charges against her and she got monitored visitation for two hours a week. According to the Order she is supposed to be going to an outpatient rehab and providing proof that she is doing so, we haven’t seen anything yet, all she provided was a letter from a sober living home that she doesn’t even live at. We did subpoena the records from this place but haven’t gotten anything back yet. We are going back to court next week and the judge said that she might be able to give her full visitation back if she provides the information requested in the order. She is definitely lying about going to the rehab, we have been to the meetings at the sober living home and she is no where to be found. How could the court give her full visitation back despite the fact that we have provided the court her extensive history, she has admitted to the abuse, has criminal charges against her and hasn’t done anything about it? We are trying to figure out if there is another way to prove that she is still using, we know that she is…just the fact that we need to prove it..any ideas?
