Ok I need a really quick answer my car payment is 3 weeks late and they send the recovery service to pick it up. I called the lender and told him that the payment will be there on friday he still sends the repossession guy over to my house. Now that guy was here last Friday and I did not get the car out of the garage for him and he can’t put a foot in my garage he threatened me the next time he will come with the police and they will bribe my garage door open. I know that they can’t do anything without a court order. So is it safe to keep my garage door closed till friday. I need some answers quick please
Yes it is the first time I am late but even the repoman said the lender is very well known to do that. I hate when ppl just assume things without knowing the facts, I sure hope you will never have anything bad happen to you so you can be on time with your payments

I’m really surprised they tried to repo a car after only 3 weeks.

Yes, your right, the repo people can’ enter your garage to get the car. If they try to force their way into the garage, then they are breaking the law and can be arrested and subject to civil suit.

Please help with, Credit Card Debt Negation Settlement Or Other options?

Seeing a friend fall deep in debt in no time, I like to help him, get an idea of what his options are – Bankruptcy or Settlement.

He made huge debt (over 50 thousand) to 4 major credit cards while in New Jersey.

Since Feb 2006, he has no job, no nothing … literally nothing, stopped paying, moved out of state, no contact with creditors or response to court orders. (A lot happened with other cards). Now,

Card-1:
With Original Creditor
Principal 10K.
With penalties 15K

Card-2
Been sold 3 times and with an outside recovery company.
Principal 19K.
With penalties 27K.

QUESTIONS:

We understand Bankruptcy may be best option… its apparent it’s quite easy in his case. BUT please advice on the below.

1) In this scenario, how much these agencies would agree for one time payment?

2) How should we proceed OR should we hire an attorney to do this work for us?

3) Are there any better options such as consolidating?

4) Plz recommend attorneys, consolidators, any thing.

Regarding how much the agencies would agree to a one time (reduced amount) payment depends on a few factors – age of the accounts, if they had sued and won (you had mentioned court), etc.

If the accounts are fairly recent and/or they received default judgments on them, they probably will not discount the amount much.

If the accounts are pretty old since he defaulted and there are no judgments, they may work with him on a much lesser amount.
If the accounts are past the collecting SOL with no judgments, they would probably be more inclined to settle for a greatly reduced amount since the only way they could “legally” get paid on the accounts is with his offer to pay. Or, if they are past the collecting SOL and there is no judgments, he has a legal right to send them a SOL letter informing them the account(s) are no longer legally collectible and he has the legal right to not pay.

He needs to order his credit reports to see who/what is reporting.
He also needs to contact the court clerks in “every” county/city he has lived in since his “very first” default and ask if there is anything filed in his name.

If he decides to try to work with them, he should first start by sending validation letters. If/when they properly validate he might send them his offer along with the requests that they consider it as “payment in full” and that they will delete what they have placed on his reports.

If he is considering bankruptcy (BK), he might speak to a BK lawyer.

You/he might also click on my profile and click on the last link I have listed. Do some reading in both the credit forum and the BK forum. (It is a “totally free” site with a great deal of info on it)
He will be able to get an idea of what it takes to try and deal with the creditors or what is involved in filing BK and would probably be able to decide if he would want to file on his own or spend the money to have a lawyer file for him.

Filing BK on ones own is not for everyone. If he reads through the forum and has any doubts about being able to handle it, he should get a lawyer

Let me get this right:
1. You enter a new continent and colonize it, murdering thousands with superior firepower;
2. You steal the indigenous people’s land, dispossessing them forever.
3. You rape their women, kidnap their children and put them in “homes” to rape them, too.
4.You bring the booze in, of course.
6. You exclude “the blacks” in every aspect of your new government.
Three centuries later, what do you do for a encore? Apparently, you announce that you’re shocked by the rampant violence, despair, and alcoholism, in the original people’s culture.
It’s got to be stopped! It’s time to ban pornography! You’ve finally gotten to the root of the thing!
Police are hired to flush out and imprison those found guilty of “possession.” By the time you round up all the offending parents, you can send a new generation into government prisons
and foster homes— what a nostalgia trip! You wiped out 80% of their population in the old days, but clearly there’s more work to be done.

Can someone please edit my essay? I just want feedback on my writing.?

Because I was once homeless myself, I am committed to helping others achieve personal growth and take an interest in their own well-being. I find that helping others is rewarding in itself and as long as I can make a positive difference in someone’s life, I will know that I have contributed to that person’s efforts to change his or her life. As a result of my personal experience, I understand the constant despair and frustration experienced by those who find it challenging to cope with everyday life and problems. I am also convinced that increasing one’s own sense of empowerment can make the difference between a future of despondency and one filled with hope.

I grew up in a single parent family household with my mother, with whom I frequently had arguments. When I found out I was going to have a baby, my relationship with my mother deteriorated further. There was too much family conflict so I left. Eventually, I found myself homeless. Needless to say, being homeless was a constant struggle. Months later, I found a shelter on Skid Row in downtown Los Angeles, which was the worst part of the experience for me. Here I was- homeless, about to have a baby, with no money and no place to live. I felt alone and felt that nobody cared about my situation. At the shelter, I met a social worker, and she helped ease my concerns. I told her of my situation with my mother and she was there for me when I needed someone to talk to. She encouraged me to resolve my conflict with my mother and go back home. When I moved back home, I made a sincere effort to heal my relationship with my mother. Six months later, I found a job as a counselor, working with adolescents who have experienced similar situations to mine. I was able to save enough money to move into my first apartment. From this experience, I learned that I had the ability to persevere through my most challenging times. I developed empathy for people struggling with everyday problems, and, most of all, I learned the importance of having support from my family. Overall, social workers make a remarkable difference in overcoming life’s challenges.

I am applying to the Master’s in Social Work Program because it is my goal to help others to embrace their inner potential in an effort to make a positive life transition. I began my preparation to achieve my personal goal while I worked at Harbor View Adolescent Center, a level-14 group home facility, as a youth counselor. My primary work responsibility was to serve as a positive role model for adolescents 12 to 18. The adolescents had backgrounds, such as being homeless and victims of physical and sexual abuse. Others had problems with drug and alcohol abuse, depression, and the criminal justice system. At times, the position was extremely stressful but I discovered that I had the ability to connect with the adolescents and develop strong emotional ties with them. I focused on several areas of treatment, including their social skills, coping skills, and independent living skills. My main ambition was to help them to build their self-esteem and improve their sense of security. As a youth counselor, I have gained valuable experience in listening to adolescents and helping them make positive decisions in order to improve the quality of the their lives. Overall, my career goal is to help vulnerable and oppressed individuals because I want to ensure that they have access to effective services, quality resources, and much needed guidance.

Most importantly, I want to become a professional social worker because I want to do everything that is within my power to enhance human well-being and help meet the needs of all people in my community, especially its most vulnerable members. This is my professional calling to do all that I can to make these people whole, empowering them so that one day many could even become be happy productive individuals.

I’v done all I know to do, Please help me and answer, it involves my son’s care?

Okay, if anyone of you have ever seen some of my other questions posted, you will know, this is a long story, so to try and make it short… My son has a dead beat dad who parents keep taking me to court to let my son be able to visit him in rehad and jail (granted they didn’t care about seeing my son EVER, not even before he went to jail) Last time we went to court, something happen and it got postponed but we found out that he is currently in rehab awaiting trial for meny felony charges in which he will go to jail. But they are giving him weekend passes to come home. We have a old outstanding order to let him have supervised visits with my son everyother weekend fri-sun. If he gets out for a past, I have to make my son go or I’m in contempt. I have a lawyer who says there is nothing I can do to stop this. But there has gotta be! Can’t I do some kind of emergency hearing to stop visits?
he gets the weekend passes from rehab. don’t you think its crazy to let someone with a drug problem out on weekends? Once when he was on his way to pick up my son, he got pulled over and was cought with a stolen, loaded gun and drugs and went to jail. He has about 7 felony charges he is awaiting trial for and they let him out on the weekends! It doesn’t make since
his visits are supervised but its by his parents and my son has to stay at there house all weekend long.

Stuck in the Middle of a custody Battle Need some legal advice Please help?

Wow Were to start Well I have bin with my Girlfriend for 3 years now. We have a fresh 8 moth old baby. And She Has a 6 year old Kid with Her X husband. I have bin suffering for 2 years now with here and her x fighting about there son. Im really tired of hearing about it and we get into a lot of fights because Im just so tired of hearing it. His father has bin out of his life for two of the 6 years and was ordered to go to rehab a number of years ago for drugs and alcahol and never even completed the rehab. He was alowed Visitation every other Weekend and thursdays. That was fine with my girlfriend. But what happend was about a week ago. My girl friend started getting anxiety and bells Polisy witch makes her face go knomb when shes very depressed and stressed out. Not to mention she has very bad eyesight. Well She took the kids to a soccer game last week and she had all her semptoms of her stress and bad eyesight. Her x called the cops saying she was drunk. But she doesnt even drink all she does is take perscribed Zaneks for stress. Well the cops came arrested her and gave her a drunk in public because she couldnt pass the eye sobrity test and the line. They arrensted her and took her in jail over night they didnt give her a breatherliser or blood test. Here X then schedualed a Imediate custody court hearing. And now her X wants 50/50 custody. And wants her to go to rehab and only have day for visitation a week that is supervised. What can she do we dont have enough money for a lawyer. I dont want to suffer anymore!!! LAWYERS PLEASE HELP! According to this letter from the prosecuting attny., how much time is my bf looking at?

First of all, my boyfriend has only had a DUI at age 18 which I don’t think went on his permenant record. He is now 33. He became a heroin addict and is being charged (I think) w/ stealing 2 checks from his former employer and cashing them. The amount totaled around $750. He was charged with 2 Class C Felonies. A year later, he stole some merchandise item from another employer. I believe it was valued around $250. This was a Class D Felony. This is the letter from the prosecuting attorney to his lawyer:

Dear Mr. ________,

In an attempt to resolve the above referenced matter, I can propose the following plea offer. The defendant would plead guilty to as charged to Count 1, Forgery, as a Class C Felony. He would be sentenced to (8) years in the IN Dept. of Corrections. Two (2) years of said sentence would be suspended and the defendant (MY BOYFRIEND) would be placed on probation for (2) years. The defendant willl be ordered to pay court costs and restitution to the victims in both counts under Cause Numbers____ and restitution to victim anunder cause number_________. The defendant may petition the court to modify his sentence to work release or GPS after serving 1/2 of the executed sentence. Upon sentencing, Count II in, Cause Cause No. __________ and Cause No._________ shall be dismissed.

My boyfriend obviously would have never done any of this had it not been for heroin. I am NOT saying he doesn’t deserve time (HE DOES) but this seems very harsh for someone who never had a record until recently.

He already has done 2 1/2 months in jail (where he is now) and was on tether for 3 months after the first arrest as a condition of his bond. He does not have any money and cannot afford the best lawyer. Nor can his lawyer suggest a rehab because my bf doesn’t have the money for rehab. I believe he deserves a year in JAIL but no time in prison.

My main question is what is he really looking at here????

Could you give me some advice on a career path, please?

Hello, I am a 20 year old boy (man?) who is trying to turn his life around. At age 16 I started using marijuana and alcohol, and from there started working my way up to harder drugs (MDMA, LSD, cocaine). But recently I had the epiphany that I need to change in order to get what I want out of life, and also in order to do the right thing. I confessed everything to my father who is deeply concerned about me.

But that’s not the point of this question. I just thought you could better answer it with that background information on me.

I want to help other people. Sit people down, and talk to them. I am a good listener and good at understanding other peoples problems and telling them what they need to hear; I’ve been good at this all my life. So I want to go professional on this. The problem is I’m not sure of the specific college degree or field I am trying to go for. Some things that do come to mind, though, are: Psychology, Psychiatry, Therapy, Counseling. I know some of these things require graduate school, which is okay, but I’d also like to know what can be accomplished with just a bachelors.

Ideally, I see myself having a steady job in which I see patients and talk to them about issues they are having and provide treatment for them. Mental disorders interest me – severe ones and mild ones. Even people who don’t have a diagnosed disorder but are just seeking help.

I am just seeking information and suggestions. If you have a job in a like field, YOUR help would be much appreciated. Thank you everyone.

What should I do? Family trouble. Please help.?

This is long but I need your help

I’m 19 (male) and my brother is 21. My brother is an alcoholic (Very violent and angry drunk) and has been since he was like 15. He’s been in and out of jail and rehab but nothing has helped him. He has a DUI and hasn’t been able to get a license for about 2 years. He currently has no job and is living at home with my parents and I. He is taking a medication called antibuse to prevent him from drinking (court order) and has been drinking anyway.

I’m working full time and attending local college. I smoke pot every week or two, but when it comes down to it I’m very responsible.

Lately my brother has been getting out of control with his drinking again and has been throwing things and breaking things, yelling and making threats.

My dilemma is that since I was 13, my life has been mostly destroyed living with my brother. He does nothing but criticize my existence and threaten me. He’s unapproachable when he’s drunk because he’s very violent and angry. He calls me and lies to me to get me to lend him money (which I dont), and yells at me when i opt no (cuz i know its for booze).

My main concern is he gets his license back soon and I can promise he will get a new DUI. I feel like it is my responsibility to tell authorities that he is still drinking uncontrollably to spare other drivers on the road. His last DUI he went 80 mph into a pole on a 45mph road and walked away with no injury.

My parents don’t know that he’s currently drinking. I’m afraid that if I say something about my brothers drinking, he will tell my parents I smoke. Which will in turn get me kicked out of the house.

What are my options to have something done about my brother’s excessive drinking problem, he’s going to end up killing himself or someone else.

He never thought it would happen to him…..After having a few drinks he got into his car and headed home, but he never made it. Lindsay took a plea deal on a misdemeanor drunk driving and possession charge where is she only served eighty four minutes in jail. Her original sentence was a day in jail but due to overcrowding in the jail she was sent free. What does this say to our society? If celebrities can get away with it why can’t we. This isn’t a good message to be sending out to our society.

HELP! My 16yr old’s 5th court for underage! PLEASE HELP ME!!!!?

First of all – if you don’t have any actual, helpful advice – don’t reply.
My 16 year old is going to court for his 3rd under age drinking, 2nd possession of marijuana and/or paraphernalia. I’ve tried everything to help him/get him to stop. I’ve taken off work to make sure he stays home – to the point that my job is in jeopardy. He bing drinks to the point of blacking out – so he told me. I wake up to go to work and they’re are 16 year old’s all over my basement (promptly kicked out) – wreaking of alcohol. I find bottles of booze hidden all over the house (which I make him dump out). The last time the police brought him home after an ambulance was called – he was passed out on the side of a road. The ambulance cleared him and the police brought him home. To my dismay, when I told them what the past year had been like and that I just didn’t know what to do anymore – they said I HAD to take him. Each court appearance (in Wisconsin) leaves me more hopeless than before – they just reduce the fine. The last was $250 – reduced to $75! (No – I don’t pay his fines!) And he still has his license! (No – he’s not allowed to drive my car).I’ve talked to treatment places, counseling, therapy, boot camps, boys camps … they all tell me the same thing – he has to go voluntarily (which he won’t… I’ve made countless appointments) or court ordered. I have a younger daughter in the house and I’m scared to death of what this craziness is doing to her!!! I KNOW what it’s doing to me! I’m not the perfect mother – I’ve made lots of mistakes, but I am a good mom. I put restrictions on him, but when I go to sleep or to work … he’s gone. I finally had it and gave him the choice – stop drinking and smoking dope … or get out. The hardest thing I’ve ever done – but I can’t condone or allow what he’s doing, and I can’t watch it anymore… and apparently I can’t stop it.! I wasn’t suprirsed when he chose to leave – but my heart was broken, I feel like I’ve given up on him – I HAVEN’T!!!! (He’s been staying with friends in the same town – I’ve called all his friend’s parents and asked them to let me know – they are also dealing with similar issues with their own kids). I’ve called Social Services and they were surprised they hadn’t been involved by the police yet. Me too! Don’t know what they can do to help … I just know I need help! He hasn’t been involved in any violenc or property damage – I’m getting the feeling that THAT has to happen before the courts get more involved. I just want some help for him BEFORE that happens, I just need some help!

Sufferers of sleep apnea answer please?

My husband’s doctor ordered sleep study for him. We already know he has sleep apnea because I’m an insomniac and can lie there watching him stop breathing over and over again. He thinks it’s a waste of time to have the study done when he already knows he has the apnea; and he says the machine to treat the apnea will be too expensive, too bulky, and we can’t afford it. Anyway, what else can they find during a sleep study that he might need to know about? And does the machine really work? How are sleep apnea sufferers doing after having the treatment? Any other suggestions? He already knows he has to lose weight and improve some other health problems. Alcohol consumption seems to contribute to the apnea, though not EVERY time he drinks (more when he drinks too much or drinks beer), and allergies contribute (from what I can observe).

Here is a heavy question for saturday morning, please read and help, everything is so messed up?

I’m going to try to shorten this as much as possible and still get all the relevant information in. When I was 10 my parents got married and my mom married a guy named Eric who was abusive and did drugs. For four years I lived with them and watched him beat my mom up and sometimes rape her. They were both drunk most of the time (or on coke) and would disappear for days at a time, leaving me home alone with my two little brothers, who were born when I was 12 and 14. I missed a lot of school watching my little brothers, and was very depressed because my home was a hellhole.

At 14 my dad got court ordered custody of me and I had to go live with him. He had been trying this whole time – and I saw him a lot those 4 years, but I was stubborn in staying so I could protect my mom, my brothers and my dog. (I had long since smuggled my cat to my dad’s apartment to protect him from my stepdad.) When I moved in with my dad I took my dog, but there wasn’t anything I could do for my mom and my brothers, and eventually there was even a third brother. Through all this time my mom and stepdad would go on binges, they would get people to watch the kids and then disappear for days at a time, they slept around on each other and it was always violent and chaotic there. I visited less and less even though I felt bad, because I was terrified of Eric and so angry and disappointed that my mom kept choosing this guy over her kids.

Eventually Eric got sent to prison, my mom disappeared and the kids got sent to foster care. The kids ended up with family in new jersey and 5 months after she disappeared my mom contacted me from a women’s rehab center where she had been attempting to get over her drug habits. She came back, got a job and apartment and without eric she was doing okay. Nearly 10 months after she had left she got the kids back and she was doing really well. That was 3 years ago, and she has been struggling with depression and falling back occasionally but for the most part has been okay. Whenever I hear from her it is always to help her with a problem, or to give her money. (Being stupid at first I gave her cash, now I realize that when she needs money for a bill or needs food to pay the bill myself or bring her shopping or the money goes to cigarettes and booze). She would have strange men over, have violent relationships and constantly used people.

I have a lot of anger built up, because she was never there for me when I really needed a mom. You know, never taught me to shave my legs or put on makeup, and I don’t want to get into the embarrassing shopping trips with my dad for girl stuff. It was more than that too, because I hated her for choosing someone that hurt her over her kids, but I still have never been able to express this anger because she breaks down, and I’ve had to be the strong one even though she was the parent.

Well, 3 months ago my stepdad got out of prison… and my mom let him right back in her life. Everyone believed that he had changed, but of course they hadn’t lived with him and seen the same act over and over. I tried to support my mom, but we kind of distanced ourselves because I did not want to see my stepdad and I was disappointed in her for letting him back in her life when she was doing so well. It only took him a month to get back on cocaine and to get her on it to. Only a month to start beating her again and for them to go on binges and stick people home and try to con money out of her family. A month ago she called me and told me that she needed money to pay the electric bill because my little brothers couldn’t be in the dark (she uses them to guilt me a lot) and I agreed to pay it and asked where to send the check. She told me it had to be in cash and that she had to deliver it, so I had to give it to her. I was disgusted that she was trying to con me out of money, since I have always given her the money she needs and helped pay her bills, and hadn’t talked to her again.

I had a very bad feeling this week and tried to call her a couple times a day, but haven’t been able to get an answer. I finally went to her house and no one was there and her apartment had been evicted. I panicked and called my grandma and she said that 4 days ago Eric violated his parole and was sent back to finish his prison term. My mom went off the deep end and got really drunk or high and ended up getting committed and the kids went to a friend of hers until DSS can figure out what to do with custody.

This isn’t the first time, and I’m 23 now, and the last 13 years have been about me helping my mom and fixing things when they go bad and I just… I have to call her, and I don’t know what to say. I can’t tell her things are alright, because they aren’t. I can’t tell her when she gets out that I’ll speak for her at DSS to get the kids back, because they have been bounced around so many times she has already ruined their lives, I think they would be better off somewhere else. I can’t tell her I’ll fix it because I love my mom but how many times can you pick someone up if they don’t even try to stand? She is my mom but… I have no faith in her, even if we get her through this Eric gets out in October and I know she will take him back and we will go through this again and again until she manages to completely destroy everyone around her.

I have to separate my little brothers and her, because they deserve my help but I’m not really sure if she does anymore. I contacted her friend and talked to the boys, they are okay, and I gave her friend some money to help with the bills but I feel so… empty about her. I want to take care of her and the boys, but she has taken advantage of and hurt everyone that has ever tried to help her, what do I do?
The boys are 10, 8 and 6.

step mom doesnt know what to do help please?

so i got married about 4 weeks ago to a man i absolutly adore. he has 2 15 year olds. 1 his blood and 1 was his sisters that he took custody of. they are both great kids if it wasnt for his adoptive daughter who has the i dont give a **** attitude. she is into drugs drinking, smoking pot, and smoking cigerets. on top of it she sneaks out all the time. i think the 2 worst parts about it is she has skipped so much school she has been court ordered to go. and is having sex. to top it all off we checked her myspace account to loan be hold our house #,cell #’s and home address also the school she goes to. i have tried to give him ideas on what to do with her. from grounding to rehab you name it i have thought of it. i even installed a monitoring system on the computer to watch her every move. but he never fully follows throu with punishment with her. it has gotten so bad its driving us a part needless to say hes 34 and im 21 so only 6 yrs older than the kids. so i have no athority

Please Help. How do I contact a person in prison in Rosharon, Texas?

Please help me. I’ve known a guy for many years and have been friends with him for that many. He comes from an affluent background (wealthy) and unfortunately, never has been in real trouble except with his drinking. (public intoxication, etc. he’s never put anyone in danger because of alcohol) He’s in prison due to breaking probation and his sentence is ten years. I’ve contacted the jail in Rosharon, Texas and was told I was not on his contact list therefore, they could not help me. I was also told I could look him up on the internet and I have…to no avail. (for days) All I’ve found were webs listing administration there. No inmates names. I know *Charlie would put me on his list if he knew where I was, but I’ve moved since then. He is the sweetest guy and would give his shirt off his back if you needed him to. I don’t know what other course to take. Again, it’s his drinking that has gotten him in trouble. And I don’t think prison is the way to go if you have an addiction. It just dries a person out.

Please help, his Mother died and he is all alone. His Father doesn’t give a hoot about him and his Dad belongs to the KKK. I am stressing over this.
