How does a parole hold work? If the person doesn’t have any charges on him for the arrest? (California)?

My brother was arrested last night, supposedly the story is that he went to help his wife at work, she is a bartender. She asked him to go and help her unload the alcohol cases. He said he went because there was no bouncer there last night. Anyways he told us they were trying to jump her and he was protecting her. I don’t know for sure but she said that some girl was starting stuff with her and I guess when they were leaving the people with this girl started messing with them and the though they were going to get jumped so I don’t know if they started fighting or what but of course something had to happen for cops to show up.

His wife said that no one was arrested accept for my brother because he was on parole and because he had alcohol in his system.

So now what happens, I went online to the inmate information to see what he was charged with and there is no charges on him only a parole hold.
Are there any chances that they will release him? Or does he automatically go back for 4 months just for the arrest?

If an inmate who was on parole hold and the charges were dismissed can they send him to program upon release?

Friend of mine was on parole and he violated due to alcohol consumption but his charges was dismissed.. at least that’s what his profile said.. he is no longer at the county jail.. they say he was transferred to another agency…what does that mean exactly.. This took place within 20 days.did they put him in a recovery program?? does anybody know??

Court Ordered parole stipulation?

In the State of Alabama, does anyone know how you would know if a stipulation was attached to a parole reinstatement? We have the paperwork from the Department of Corrections stating that Parole has been reinstated, but nothing states that a rehab program was court ordered. Does anyone know if a court ordered program should have been noted on this doc if it were required as a stipulation of the reinstatement?
The parole board neither the DOC stated that it had to be done…….that is why I am asking if anyone knows how this would be noted. There were no docs stating that it was a stipulation!

Parole Stipulations?

If a parolee is required to attend and participate in an out-patient drug rehabilitation program which is 4 nights a week from 4pm-7pm and Alcoholic Anonymous meetings the nights they do not go to rehab, which gets out around 8-8:30pm each night; can the Parole officer demand and enforce a 7pm curfew?

I know someone was told that he has to go to this particular rehab program when he is released on Parole, (which is the only option is 4pm-7pm) which he would be home between 7:30-8pm and attend AA meetings on the opposite nights.

He was told that the Parole Officer is demanding or “recommending” a 7pm curfew. If this is the case he will be violating his parole either by not going to rehab and AA meetings or breaking curfew.

He said he rather max out 5 more years than be set up to fail and violate Parole. The Parole Board will do nothing. Can they do this?
He cannot afford a lawyer, (public defenders are not free here in NH) and the judge has nothing to do with parole stipulations. He had already been in contact with his Parole Officer and the Parole Board.

He has a social worker who is also working on trying to get the PO to move the curfew up to 9pm. The Parole Board said that this has nothing to do with them and the PO will not change his mind.
Just heard back from the chairman of the Parole Board. He stated that the Parole Officer should not be imposes any stipulations that will interfer with his Parole.

Apparently this Parole officer was just causing trouble. The Parole Board will be carefully looking over the Parole Plan and take care of this situation accordingly when it comes to thier attention.

Parole Violation? Plz help.?

A friend of mine was arrested for robbery and resisting arrest… he did 2 years in prison, and they sent him to a court ordered rehab.. He did a few months at the rehab, but got kicked out, than signed up to get into a different rehab.. which he did a week in that one…he just left this last Friday… and his court date is Wednesday.. The remainder of his time is supposed to be untill april 17th 2009, will he only have to finish that time or will he have to do more?
