Question by Roslyn B: Can a judge lie to parents in a drug court where their child is enrolled?
I have been humiliated told I was tested positive for drugs and lied to by judge dellick in front of my child. I have been accused of being a drug addict even though the tests were always a mistake. She has taken away my child my family and my job. Is a judge allowed to order a test that she swore was only an alcohol test and lie and use it as a drug test?

Q&A: Can judges order parents to pay their child’s court costs/fees/fines?

Question by Stacy A: Can judges order parents to pay their child’s court costs/fees/fines?
I’m a law student intern for a juvenile court. Our county has tons of oustanding court costs/fines/fees from juveniles. I’ve been researching Lexis/Westlaw for a couple of weeks with no luck.
1)can parents be held responsible for their minor child’s financial orders/judgments?
2) Or, must the parents be ordered to pay fines/costs?
3) If so, must that order be made specifically at the time of the hearing or can it be made later as a method of recovery?
I’m looking specifically for Ohio law but will take anything at this point. I have found alot of info regarding parental responsibility in regard to restitution, detention costs but nothing specially (caselaw, statute) as to whether this extends for court fees. Would adding a disclaimer/signature area to a payment plan for juveniles that parents would sign assuming responsibility hold up under the law since contracts typically aren’t enforceable against minors? Any help is appreciated.

in contractual law a parent is responsible for any debt that a child under 18 incurs. that would include court fines.

Q&A: Is there PA law that allows parents to force their minor child (15) into drug rehab?

Question by Cassie: Is there PA law that allows parents to force their minor child (15) into drug rehab?
Its actually for my child. I called a few treatment centers and they said they won’t take her. I find it appalling a parent wouldn’t have this right over their child!

If your parents have custody of you, then yes, they can require you to go to drug rehab, or military school, or boarding school, as long as the facility is itself legal and licensed.
ETA: The facilities you’re contacting may not want to take anyone, minor or not, who has to be forced into rehab. It’s not a question of law but the choice of the facility about who they treat.

What legal right do I have concerning my parents?

I’m 17. I’m considering emancipating myself from my parents. I no longer live with my parents, and im currently looking for a job. I know those two things are required before going to court. My father is an alcoholic and my mother is a convicted felon who has left my family 3 times. My parents have always neglected me and cant even make it without the assistance of my grandparents. Is there anyway my case could hold up in court? If so is there anyway I could just get a portion of my grandparents money back for them?
How can I stop acting cold to my parents because of their son who is an bad drunk ?

My brother has a drinking problem, he is 33 yrs old…He went to rehab for 35 days (court ordered)…He came home 3 weeks ago and started drinking again (that night). He is now in a hospital since he tried to take his own life the other day, which I have no sympathy for since it’s all for attention… Drinking issue affects everyone…That is what some people don’t realize…This has been going on for 15 years in my life..I’m the youngest and boy was it a tough life with him…My parents want the best for him but how some parents react is to hide and baby their kids…He is 33 but when he needs something he is 12 again…My brother lost his family…3 beautiful kids and his wife and he is only an inch a way from losing me…I have his kids pretty much every weekend and love them with all my heart…their mom is really the same as my brother with drinking except she isn’t violent but she is not a good role model at all… but according to social services she is great..I refuse to mess with the system cause I couldn’t bear it to backfire and me to never see the kids or even not see them for 2 weeks…My problem is I get angry and fight with my parents over him all the time..I get pissed at the mention of his name..even though I do care I refuse to admit it to them..:example: I live 45min from my family because of my brother… I just called my mom for something totally unrelated to my brother and within 3 seconds of “Hello” she was telling me about my brother…(same story over and over again) I cut it off and say “I can’t do this, I don’t care”..she gets upset and says…I’ll talk to you later…I’m at a loss how to handle myself…IDEAS???
How do I tell my parents that I want to go to rehab without them disowning me?

My father is a recovering alcoholic drug addict of 17 years. I have an older sister that has 2 children that my mother is raising because my sister abuses meth. I have an older brother who has had 2 DUIs before his 21st birthday && I have been following in their footsteps. It started when I was 14 with drinking then when I was 16 I began smoking marijuana. Now I smoke, drink, && do coke on a daily basis. I dont want to end up like my sister && brother, but I am afraid I will. I am being evicted from my apartment because of my habits && I have also neglected speeding tickets, && court ordered NA && Community Service. My life is heading the WRONG way && I desprately want to change it. I want my family to be proud of me. I come from a pretty wealthy family && I want to go to rehab, but I would need them to pay for it. My parents know I smoke weed, but they dont know about the coke && my driniing habits && I am afraid that they might disown me because coke was my fathers drug of choice too
I really really want to get myself back together again, but how do I convince my parents that I really DO want the help? They have sent my oldest sister to rehab several times with no luck. How do I say all of this to them without killing them inside?? I know I am babbling but I really want to help myself, I just dont want to tear my family apart…. What do I do?
My parents are unaware that I am being evicted && they also do not know that I already have 2 misdemeanors for posession of marijuana, so I will be dropping a huge bomb on them, I just dont know if they can handle another drug abusing kid…. I feel so horrible… Please any advice, I am looking to make myself better so please please serious answers only. Im not looking for your opinion on how I have lived my life, trust me, my own opinion of my life is much worse than yours.
If it makes any difference, I am 19 now. I moved out as soon as I turned 18 becaue I had a horrible relationship with my father && his new wife (who USED to be my babysitter & moms bestfriend till the affair was made public).
How can I change which one of my parents have custody of me?

I am 15, and my parents currently have 50/50 custody over me and my younger sister. We spend one week with my dad, and then one week with my mom, etc. My dad, under my parent’s divorce degree, is not suppose to be drinking while we are at his house, but he is an alcoholic and has been drinking for the whole 5 years that my parents have been divorced. My dad is very unreasonable, and is always taking his anger out on me for things that hes mad at my mom about. He was previously abusive with me, not my sister, but has not been recently. I can’t talk to him about anything, because he is always accusing me of being a liar, and doesn’t usually let me leave the house. If we have snow days, he comes up with any excuse he can to not let me leave the house, while he lets my younger sister do whatever she wants. I am really sick of having to deal with him, and would like to live with my mom full-time. The judge said that i would be able to make this choice when my parents feel it’s appropriate, but my dad went to court to have it put in the divorce degree that I cannot choose for myself until I am 18. Both my mom and I think that this is very unreasonable, and that I should be able to choose now, but there is no way that I can sit my dad down and talk to him without making our relationship absolutely horrible. My dad always thinks that anything I say is something that my mom told me to say to him, which is never true. I have been wanting to move out of my dad’s house since the 5th grade when we first started going from one parents house to the other on a routine schedule. I want my mom to have full custody of me, but I don’t know how it’s possible if it’s written in the degree that I can’t change that until I am 18, but at that point it will be useless because I will be away at college. I am wondering if there is anything else I can do so my mom has full custody? And, would there be any consequences if I were to have one of my friends help me move all my stuff from my dads house to my moms house while my dad is not home, and then just tell my dad that I am not talking to him anymore? Would my sister have to come with me? Currently, she has no idea that any of this is going on. She is starting to not like it here, but I do not think she is to the point where I am, where I cannot stand it anymore. If i left and she still had to spend dad’s weeks with him, he would probably be very mean to her, because I would not be here for him to pick on. What should I do to make this as easy as possible for both of us? My dad has always effected my school-work, by doing things such as not signing papers that I need to turn in, not giving me time to complete my homework by making me do chores the whole night, and not driving me to mandatory school functions. I take extra classes after school, and he has just recently decided to pick me up from those so he would not have to pay my mom eight dollars a trip, but makes me wait at the school for an hour after I get out of my last class. I also take half of my classes at the advanced science and math center in my district, and have not been able to attend one after school function for that school because my dad refuses to drive me. I need to attend these things for the chance of getting scholarship money, and he has not helped one bit, and has already made it clear that he is not going to help me pay for my college education. I need to get out of here so I can do the things that I have to and would like to do with my life, but cannot think of any easy way. Is there something else I can do?

Do you have to have your parents at underage drinking classes if you’re over 18? Doesn’t make sense.?
Posted by admin in Uncategorized on April 26, 2010
Ok, I am 20, 21 in just under 6 months, about a month ago I got an underage drinking ticket, zero tolerance, just a couple of beers, pretty sober. Anyways, went to court today, I have to take 3 two hour underage drinking deterrence classes in June, at the cost of $125, and your parents are REQUIRED to go to the first session, which isn’t a problem, but it’s making me question things regarding the drinking law, because at 20, I am two years past what is considered being an adult, so why do my parents have to come? This makes zero sense to me whatsoever. Anyone think it makes sense?
understood 21 is the legal age for consumption, but if 18 is the legal age for being an adult, why should your parents have to come with you to a class when you are out of their control?
Parents at court ordered underage drinking classes, over 18?
