A couple days ago, I saw a show that had parodies of the Law & Order characters, with Det. Briscoe constantly commenting on his alcoholism and his ex-wives. Any idea what show this was? It’s killing me!!!!!

I want my tenants removed from my home. We went to court and agreed (since there was no lease and no written agreement) that I would give them 30 days to vacate and as the jude VERBALLY explained after 30 days they will issue a WRIT and they will be thrown out physically if need be.
However when I look at the ‘settlement agreement’ we all signed in the courtroom there are 3 options at the bottom and the judge marked all 3??
1) no writ of recovery is requested at this time. The signed agreement serves as settlement.
2) Defendant(s) shall vacate on or before 11-16-11 or a WRIT OF RECOVERY shall be issued by default by request and payment of fee.
3) if there is a violation of the above terms, judement may be entered and Plantiff will obatin a Writ of Recovery , upon filing of an affidavit establishing such fact.

SO…is it AUTOMATIC WRIT after 30 days or do I have to go to court again or what??

If they do not vacate after the 30 days, you have to go back to court and obtain a Writ – which you will have to pay for. The Writ will be issued automatically – without delay and without your tenants needing to appear.

You would then need to take your signed Writ to the Sheriff’s Department and pay a fee to them to proceed with the physical eviction.

We know baby mama has a drug problem. The problem is, we know if she gets the heads up that she is being drug tested and if she is given enough time, she’ll clean up her act temporarily. Is there any way to get a drug test ordered quickly, because we know she has used at least, valium, oxys and marijuana within the last week.
and to all you marijuana lovers, don’t get all up in arms, i dont’ care about it, i only care because its one of the many drugs this idiot is doped up on, on a regular basis while she should be caring for my stepdaughter
For now we’d like to keep CPS out of it, i hear once they are in your life both the mother and father go under a microscope. We have nothing to hide, but we don’t want them up our butts.
Yes Kiersten, she uses around the baby, shes on pills everyday. And that in its own right is unfit according to the law where I live.

My son who is 17 has a drinking problem. I found two big bottles of vodka in his room and vodka concealed in water bottles in his refrigerator. I have found a treatment center in the area that I have made an appointment with but my son refuses to go saying he doesn’t have a problem. The treatment center said I might have to get a Court order issued. How do I go about doing that if I can’t convince my son to go.

talk to his physician & your attorney. see what qualifications are required by your insurance company.

If it’s a court order you/your ex really don’t have a say in it. I’m guessing the “consent” part simply means the person has agreed to take the test and the blood or urine was not taken without consent.

My husband and i are raising 5 kids,from 3 up to 14,we are happy,steady and comfortable right now,DFCS called and said there was allegations of abuse,which there’s no way,and pot smoking,we smoked the other day and now i’m terrified i’m gonna loose my kids! I’ve never been in a mess like this,can they make us take the drug test without a court order or even a case against us???
I tested negative and my husband tested positive!!

No worries Amy they cannot take your kids away over pot. You say that they claim abuse, if they can prove this then yes they will. But you say you did not and if true you have nothing to worry about.

Just so you know Amy it is abuse to use illegal drugs in front of your children. If your own children told someone that you were smoking pot and they passed it on to DFCS, you could be in VERY big trouble.. just an fyi

Im 3 months pregnant. My relationship with my ex is just NEVER going to function, trust me we’ve tried very hard. He is aggressive, violent, verbally/mentally abusive, started to show recovery of being an alcoholic but went right back, and not to mention that he’s got his priorities all messed up and has already threatened to take our child away after its born.
I want to put a restraint order primarily for my safety and of my unborn child.
Will this also help prove my case in court should he take me there? Would it be harder for him to get and rights on the baby?

Speak to someone at an abuse shelter. They will be able to direct you on your state laws and any lawyers that may be able to help you free fo charge. To answer your question in most states and in most cases yes, but nto always. Please talk to someone at an abuse shelter or abuse hotline.

I’m a law student intern for a juvenile court. Our county has tons of oustanding court costs/fines/fees from juveniles. I’ve been researching Lexis/Westlaw for a couple of weeks with no luck.
1)can parents be held responsible for their minor child’s financial orders/judgments?
2) Or, must the parents be ordered to pay fines/costs?
3) If so, must that order be made specifically at the time of the hearing or can it be made later as a method of recovery?

I’m looking specifically for Ohio law but will take anything at this point. I have found alot of info regarding parental responsibility in regard to restitution, detention costs but nothing specially (caselaw, statute) as to whether this extends for court fees. Would adding a disclaimer/signature area to a payment plan for juveniles that parents would sign assuming responsibility hold up under the law since contracts typically aren’t enforceable against minors? Any help is appreciated.

in contractual law a parent is responsible for any debt that a child under 18 incurs. that would include court fines.

there is about a 99.9% chance there is a warrant out for your arrest, what, do you think they are just going to forget about it? No way. You don’t just get “lost in the system”, whatever the hell that means.

I mean, immediately, and with other states- assuming a judge in another state has ordered you to have “no consumption of alcohol”? I’m referring to the paper on which they take down your driver’s license #, and ask you to sign? Like a sports bar.

i dont know what bar your going to that documents everyone who walks in the door but no they cannot reveal personal information unless a court order is executed to investigate your personal records, including bar records i guess. never heard of a bar doing that though.

justifiable and provable cause, be required to provide a security bond (cash or certificate), that they forfeit the next time they violate the orders?

With 60% of court ordered visitation violated within the first six months of the order, according to the U.S. Dept. of Health & Human Services study, “Survey of Absentee Parents”, and no government programs to enforce, this could be an effective way to address the issue. Unlike child support, visitation recovery stops when the child reaches 18. And, in today’s economy, judges can no longer automatically jail those who violate family court orders. States are releasing prisoners, without the need for probation reporting, in increasing numbers.

A bond can be in cash or through a bonding agency.

You really should read more of my answers before assuming I’m bias. I drop hammers on father who created their own problems, and I told mothers how to enforce orders. I tell fathers to wait until their children are grown before starting another family. Check my advice to women wanting to marry men with children, or visa versa,

Finally, I want to make things harder for fathers, not easier, by promoting Bird Nest custody.

I think holding the custodial parent responsible for carrying out the court’s orders is a good thing. Right now the non-custodial parent has almost no rights if the custodial parent decides to deny visitation. My husband had to go through this with his son’s mother. She would change her mind about letting him see his son, not be at the prearranged meeting places, lie about what times they would be home to pick up my stepson. And every time we called the Police Dept. they said to call the Sheriff’s Dept, who said to call the Attorney General’s office, who pretty much said sucks to be you. Sure there are a lot of people who are neglecting their duties as parents, but there are a lot of parents who are basically at the mercy of the custodial parent’s whims. We had to go to court again and have it added to the custody agreement that we could pick him up from school just to avoid dealing with a mother who should be happy that her son’s father wanted to see him as much as possible. Instead she did everything in her power to make us and her own son miserable. Who’s looking out for the parents trying to do the right thing who are getting shafted? Nobody.
