I have been humiliated told I was tested positive for drugs and lied to by judge dellick in front of my child. I have been accused of being a drug addict even though the tests were always a mistake.She has taken away my child my family and my job. Is a judge allowed to order a test that she swore was only an alcohol test and lie and use it as a drug test?

Judge wants to send my teen with Conduct disorder to Residential treatment center 300 miles away from my home. He plans on his decision next month. I found a Residential center that my insurance will pay 100%, and 38 miles away. Would it be appropriate to send Judge a letter informing him that I’ve decided to place her in a different RTC than what he may order? My child is in serious need of treatment, and her placement could occur 5 days before his decision. I’m not wanting to step on his toes per say, but his idea of RTC will not allow for my participation in her recovery due to distance. I’m putting in urgent calls to her probation officer, and she’s not returning my calls. But in court she tells the Judge that my child is high on her list. But she’s not high enough when I place urgent callls for her to return my call. I’m not indigent, and I don’t need the state to pay for the mental health of my child. What should I do? Am I wrong for overstepping his choice?

If he is 300 miles away the lesson will be lurned better. I think the point is he is sending him far away for he doesn’t always get mom comfort. He has to learn has to exsept consiquenses

Question by Mike: Does the probation dept. have to provide an interpreter for a class ordered by a judge? ?
With the ADA laws, I’m just wondering if the probation department is required to provide a sign language interpreter to a legally deaf individual for a drug and alcohol class that was ordered to be taken by the judge? Based on my understanding of the ADA I believe that they do.

correct under the ADA they should be required to provide an interpreter. but also do some research on the rehabilitation act of 1973 (i believe that is the date) do some research on that and then bring that up and THEN you will get what you need because under THIS act if they say they are not required under the ADA they ARE required under that specific act.

(i going to school to be a sign language interpreter..and i actually just learned this yesterday)

I went about 10 times but still have more to do……….I have moved out of state and have not gone for about four months…should i be worried about a warrant or anything??? some people say i will get lost in the system but I am not sure….

there is about a 99.9% chance there is a warrant out for your arrest, what, do you think they are just going to forget about it? No way. You don’t just get “lost in the system”, whatever the hell that means.

An eastern Idaho judge who lost patience with the disruptive behavior of a defendant ordered court officials to tape the man’s mouth shut with duct tape during a court hearing. The unusual move was ordered by 6th District Judge Peter D. McDermott during a probation violation hearing for Nicklas Frasure, 23.

Frasure was convicted of felony theft in 2008, but the judge retained jurisdiction for sentencing depending on Frasure’s response to treatment. In October, Frasure was released from a state mental hospital in Blackfoot.

He is accused of violating his probation by not taking prescribed medication.

During the hearing, witnesses told the judge that Frasure’s behavior had been strange and erratic since his release from the state hospital. They also said he has not been taking his medication and has been consuming alcohol, factors also contributing to mood and emotional swings.

Probation officer Julie Guiberson testified that Frasure is a threat to himself and others.

During Monday’s hearing, Frasure interrupted the proceedings with repeated verbal outbursts and unusual behavior and ignored several orders from McDermott to restrain himself. After another series of outbursts, McDermott told bailiffs to silence Frasure.

The bailiffs then found a roll of duct tape, tore off a piece and put it over Frasure’s mouth, according to the Idaho State Journal.

“He’s obviously not mentally competent,” Frasure’s lawyer Kent Reynolds told the judge.

Earlier in the hearing, Reynolds had asked the judge to order a mental competency evaluation for Frasure.

McDermott said he would consider the request, but did not immediately rule on it. McDermott placed Frasure under the jurisdiction of the Idaho Department of Correction. He is being held in the Bannock County Jail awaiting transfer to a state facility. Officials, citing privacy rules, declined to say where he would be transferred.

An Associated Press call for comment, left with the Idaho Judicial Council, was not immediately returned Tuesday. The council investigates all complaints filed against Idaho judges.

The American Civil Liberties of Idaho refrained, for now, from commenting on McDermott’s decision to silence Frasure.

“The ACLU of Idaho cannot comment on the specifics of this case,” said Monica Hopkins, executive director. “However, on one hand judges have a right to keep order in their court and on the other the defendants have a right to assist in their own defense and be present at trial. Our hope is that judges employ the least restrictive manner of keeping order in their courts.”

At the end of the hearing, the judge ordered bailiffs to remove the gag and said he hoped Frasure’s condition would improve with being under state custody.

Frasure responded, “You want to arm wrestle?” as he was led out of the courtroom by bailiffs.
