in a custody case if my ex refuse`s to take a hair folical drug test is it the same as admitting guilt? or is it a right to refuse?

If it was ordered and refused, that is contempt of court. Jail or heavy fine would be involved. Then it would be ordered again. If refused, the same. Over and over until it is done to the courts satisfaction.

If the mom test results comes back positive for drugs, will the judge take the baby right then from the mom or wait till we go back to court July 29th and take her?
Has anyone been in this situation or know of anyone that has? What was the outcome?
We are in Oklahoma. Our son took the same test and his test came back negative.

The child will be taken by police and taken to child services or they will come take the baby themselves. I know you can take steps to get custody so you don’t loose her to child services.
And she can get her kids back eventually as long as steps are taken by her, and she follows rules.

and didn’t go and take it (custody case) what would happen to them in court if the other party is asking for custody of the child until the drug test is taken or has anyone been through something like this before

The person is charged with Contempt and goes to jail. The hair is taken from them while in jail.

you have to do it and costs between 300-700 bucks

If there is a reason for missing the test, than there wouldn’t really be any penalizing.
If the person just didn’t show up to the test, than that could probably go as evidence not in their favor. Seeing as it seems that they neither care nor are they willing to take the test…..which pretty much means there is evidence of them using drugs.

i know my childs mother has used a lot of drugs in the past, we are going through custody and divorce battle. We have to take a court ordered drug follice test. How far does it go back in the state fo mississippi? And is there anyway she can pass it? I want to make sure my daughter is not being exposed to this kind of lifestyle. please help.

The oldest use will be reflected at the end of the longest hair, most recent on the part closest to the scalp, so depending on how long the hair is it will show years of drug use.

Friends of mine are going thru a custody battle. The Judge ordered a hair follicle drug test. The lab said it would be over 0. Who pays for this? The ones being tested or the courts?

The court does NOT pay for this.
Generally, the court’s order will include a description of who pays for it. If nobody asked the judge to order the other party to pay for the test, it should probably be 50/50.

No. They have the right to compel it. However, they also have to have probable cause.
One basis of course is that if you’re on probation or parole, yes, they can make you submit to it.

It’s obvious she did. She had rehab? Then A hair shaving rampage….She’s trying to get clean b4 K. Fed accuses her of drug use then the child custody judge orders a Drug Test. To bad for her that it takes 30 days to get a clean bill of HAIR even after you shave it!
