Question by j: what kind of ‘order’ is this from the judge?
I want my tenants removed from my home. We went to court and agreed (since there was no lease and no written agreement) that I would give them 30 days to vacate and as the jude VERBALLY explained after 30 days they will issue a WRIT and they will be thrown out physically if need be.
However when I look at the ‘settlement agreement’ we all signed in the courtroom there are 3 options at the bottom and the judge marked all 3??
1) no writ of recovery is requested at this time. The signed agreement serves as settlement.
2) Defendant(s) shall vacate on or before 11-16-11 or a WRIT OF RECOVERY shall be issued by default by request and payment of fee.
3) if there is a violation of the above terms, judement may be entered and Plantiff will obatin a Writ of Recovery , upon filing of an affidavit establishing such fact.

SO…is it AUTOMATIC WRIT after 30 days or do I have to go to court again or what??

If they do not vacate after the 30 days, you have to go back to court and obtain a Writ – which you will have to pay for. The Writ will be issued automatically – without delay and without your tenants needing to appear.

You would then need to take your signed Writ to the Sheriff’s Department and pay a fee to them to proceed with the physical eviction.

that in accordance with the official code of GA.40-11-5 My car has been declared abandoned and subject to a lien for redemption fees due. the letter goes on to state my rights ? responsibilities to prevent the person/company recovering and declaring this vehicle abandoned from seeking a court order to sell at public auction for fees due are basically 1- disclaim ownership by sighing where indicated and returning letter to listed company 2-I have the right to pay their fee 5.00 and all related fees
3-request a hearing to determine the validity of the person/company recovering described vehicle. Also says to request a hearing I must notify them & magistrate court in writing ! I No longer live there However my brother still does.The car was parked in the parking spot assigned to the condo in which we lived. The Listed date of recovery is FRI AUG 12 2011 Date declared abandoned listed as MON SEPT 26 2011.I just singed for the letter yesterday SEPT 19th. any and all assistance regarding this matter will be greatly appreciated.

Call the agency that sent you the letter and ask them about the dates and if there was an error or something.

My sister is 17 and has been in a court ordered drug rehab facility for the past 8 months.

She now gets 12 hours visits away from the facility, and on those visits my mother likes to have her go tanning, to the mall, get nails done, etc. I think that time should be spent going to colleges, the library … something like that so that when she is out she can do something with her life. My mom says this is her “reward” time and has elaborate plans for fun stuff.

I think rehab can be a crock and your sister should look into RR (rational recovery). On the other hand, your sister should decide what she wants to do with her free time. If the rehab program is a good program, it will be teaching her about self care and about pursuing goals in life (first case, what your mom is doing, second case, what you want). Based on what she decides her values are and aligning her goals with these, she can best use her time.

Ok so I’m in treatment that’s court ordered for an OWI I got back in ’06(I’m just taking the steps to get my licence back) Anyways in the group class we have they encourage soberity which is fine I’ve been dry for 18 days and anyways a guy in class mentioned theres a song from one of the guys that’s in the eagles that talk about his recovery from his drinking and drug addiction. Claims he saw it on Youtube.com so I’m just wondering if anyone out there knows of that video or song clip and where I can listen to it..Thanks so much and for those on the road to recovery from drinking or drugs your doing the right thing for yourself and your family.

There was no court order, it was by my parents & I have a clean record. Is there a way to show & let them know that I’m Stable? Is there a psych test? I want to get into Law Enforcement (Bail Enforcement/Fugitive Recovery (Bounty Hunting), Private Investigation or Body Guard).

Is anyone else getting bizarre calls from Portfolio Recovery? They say I owe on a Visa bill from 1993! I told them I did not and they keep calling with threats and insults. I told them to take me to court and get a judge to order me to pay after they prove the debt is real.

The calls started sometime last summer and this is the first I’ve heard that I owe money from 1993.

Are these people are valid company or are they manufacturing /buying fake debt records?

The telephone number they are contacting me on is in Illinois. To what government agency can I report them to?

Tell them that this is not a valid debt, and instruct them to stop calling you, or you will sue them under the provisions of the Fair Debt Collection Practices Act.

If you have an answering machine, inform them you are taping that call and then read them that statement. Then tape any future calls. Keep a written log too.

You should also follow up with a written letter stating the same, sent certified mail.

Under the Act, you really can sue them if they continue contacting you, except if they notify you about a complaint they’ve filed.

Report any problems you have with a debt collector to your state Attorney General’ s office and the Federal Trade Commission. Many states have their own debt collection laws, and your Attorney General’ s office can help you determine your rights

I am an addict in recovery with 19 months clean time. My ex-husband divorced me and got sole custody of my daughter three years ago while I was in jail for drug related offenses. (She will be 9 yrs old in March 2007) He has blocked every attempt at contact. Recently, the court has ordered visitation. I the first visitation was supervised by my daughter’s court appointed Guardian Ad Litem, and after a few minutes of hesitancy, it was like we had never been apart. The second time was unsupervised at my elder daughter’s house. When he dropped her off, she acted scared to be left with me until he left. Then she was affectionate, loving, and we had a great time together. She was also extremely happy to see her siblings, whom he has cut her off from also. When it was time for him to pick her up, she again acted fearful of us, and refused to take with her the gifts we had given her. Now he has filed with the court to move to Arizona. Just getting visitation has already drained me financially.

Get off Yahoo answers and get to an attorney. That person is in a position to help you. I am sure there is legal aid in your state based on the income.

BARTOW, Fla. – A judge has ordered a man who pleaded guilty to vehicular homicide to display a large picture of the victim in his home after serving two years in prison.
Circuit Judge Robert Doyel said Friday that the picture must be at least 2 feet wide and displayed prominently. It also must include lettering that says: ‘I’m sorry I killed you.’
Arthur Pierce, 31, was racing with his cousin on a busy street when they caused an accident that killed 17-year-old Chelsi Gregory, authorities said. Witnesses told police Pierce was swerving in traffic at about 120 mph when his Cadillac collided with a pickup in which Gregory was a passenger.
A prosecutor also said alcohol was a factor in the crash. Pierce’s cousin, Christopher Pierce, is set to be sentenced April 5.
An advocate for Mothers Against Drunk Driving requested the photograph be part of Pierce’s sentence, according to The Ledger of Lakeland newspaper.
The judge said that Pierce’s probation officer will be allowed to search his hom
The judge said that Pierce’s probation officer will be allowed to search his home at any time, and if the photograph is not displayed, it will be considered a probation violation.
