First of all, my boyfriend has only had a DUI at age 18 which I don’t think went on his permenant record. He is now 33. He became a heroin addict and is being charged (I think) w/ stealing 2 checks from his former employer and cashing them. The amount totaled around $750. He was charged with 2 Class C Felonies. A year later, he stole some merchandise item from another employer. I believe it was valued around $250. This was a Class D Felony. This is the letter from the prosecuting attorney to his lawyer:
Dear Mr. ________,
In an attempt to resolve the above referenced matter, I can propose the following plea offer. The defendant would plead guilty to as charged to Count 1, Forgery, as a Class C Felony. He would be sentenced to (8) years in the IN Dept. of Corrections. Two (2) years of said sentence would be suspended and the defendant (MY BOYFRIEND) would be placed on probation for (2) years. The defendant willl be ordered to pay court costs and restitution to the victims in both counts under Cause Numbers____ and restitution to victim anunder cause number_________. The defendant may petition the court to modify his sentence to work release or GPS after serving 1/2 of the executed sentence. Upon sentencing, Count II in, Cause Cause No. __________ and Cause No._________ shall be dismissed.
PLEASE DISCUSS THIS MATTER WITH YOURR CLIENT AND ADVISE AT YOUR EARLIEST POSSIBLE OPPORTUNITY.
My boyfriend obviously would have never done any of this had it not been for heroin. I am NOT saying he doesn’t deserve time (HE DOES) but this seems very harsh for someone who never had a record until recently.
He already has done 2 1/2 months in jail (where he is now) and was on tether for 3 months after the first arrest as a condition of his bond. He does not have any money and cannot afford the best lawyer. Nor can his lawyer suggest a rehab because my bf doesn’t have the money for rehab. I believe he deserves a year in JAIL but no time in prison.
My main question is what is he really looking at here????

My friend has battling drug addiction since he was 18, he’s now 38. Because of the addiction, he’s spent most of his life in prison. He’s currently on probation now and has entered a rehab for 6 mos. He’s never worked The Steps. I’m hoping he’s doing this to help himself and to keep from finishing off his sentence. I know it’s going to be a struggle, but I wonder if he can do it. He use to tell me he couldn’t sleep at night, he dreamed of doing crack, he could smell it at times. We didn’t get together because I was scared he was going to relapse and go back to the street. He ended up marrying someone else and what I was scared of happened.

1 out of 100 American adults are in jail. When you see that figure, what comes to mind? You may ask yourself, “Why are so much people in jail?”
One of the big answers is: Marijuana. In the year 2006, 43.9 percent of the 1,889,810 total arrests for drug violations were for marijuana- a total of 829,627. Out of that 829k, 738,916 people were arrested for just marijuana possession alone. Think of how much it would have risen since then? In the recent news report about the jail rates it said on average a state spends 25k per inmate. That’s around 18,472,900 dollars- If they where arrested all in the same state, since some sates spend even more, or less per inmates.
Oh, yes. Don’t forget the cost of fighting Marijuana “States spent $42.89 billion on Corrections in 2005 alone. To compare, states only spent $24.69 billion on public assistance.” So, in 2006 to around 2005, if you add all that up, the cost of jailing the inmates, and the correction costs: it all adds up to more then 42,908,472.900 being spent!
Those 829,627 people did nothing wrong, they did no violent act. If free they’d be any normal working tax payer in the US.
The point of this article is to show you that Marijuana isn’t the work of a bad force. Rather the work of a good force but clouded by the government and its drug laws. If we stopped spending all that money, we could put it into something that’d help the economy. Give it to schools, or help feed some poor people. This war on drugs has done nothing to stop the flood of drugs entering the US. “Did alcohol use decrease during the Alcohol Prohibition? No.” in fact “Consumption by women and children increased dramatically” Today we’re seeing the exact same thing when it comes to the drug war. “Every hour spent investigating a drug user or seller is an hour that could have been used to find a missing child…”
I’m in favor of legalizing drugs. According to my value system, if people want to kill themselves, they have every right to do so. Most of the harm that comes from drugs is because they are illegal.”

I voluntarily entered outpatient treatment for alcohol abuse and I have noticed that treatment centers seem to border on abuse. Their tactics make one feel like a criminal instead of a medical patient that actively seeks help. They have group therapy that involves other clients saying mean things to each other. I don’t understand this idea of tearing up your character to build you back up. The counselors say that it is supposed to be uncomfortable in order to gain the benefits. I would appreciate feedback from experience as either clients in treatment and other professionals please before I just quit this program. I am now sober 4 months and feel fine about just simply not drinking anymore. that is the way I felt before I entered this program. I thought I would just be open minded to try this and learn something new, but everyday I go in I leave feeling like everything I do is just wrong. No one is pressuring me to go to these torture sessions so I would like to hear about what others went through and your outcome please before I decide to tell them that I feel like I am just wasting my money. I was 6 weeks sober when I signed up.

I was taking Level 1 substance abuse treatment (group counseling) due to court order (DUI) in other state. I still need to take 16 hours of classes. But, I re-located to Honolulu HI.
And having hard time finding agency who conducts Alcohol group class.
Do you know some counselor or group I can contact with?
Can I contract the Alcoholism Disease from attending an AA meting? ?

I was court ordered to go to Alcoholics Anonymous meetings. I was arrested for driving under the influence of a controlled substance, not alcohol. I enjoy taking Ambien sleeping pills, they help me sleep. That particular night I suppose I drove somewhere, Ambien causes blackout in high doses.
Anyways, I was court ordered to Alcoholics Anonymous for some reason. I don’t drink, alcohol hurts my stomach.
I was sitting in the Alcoholics Anonymous meeting and I keep hearing everyone saying that they have a disease called Alcoholism. I have never heard of this Alcoholism Disease. I have heard of alcoholism, but I always thought if someone had alcoholism then they were homeless people. This confused me because I have to sit amongst these people and I don’t want to catch some disease. Is there a doctor at these AA meetings that is diagnosing these people with the Alcoholism Disease? I haven’t been diagnosed with the alcoholism disease, I have had people at the meeting tell me that I’m an alcoholic but they didn’t appear to be doctors. Does anyone know of any precautions I can take while I go to these AA meetings, so I don’t get the alcoholism virus?
I’m very concerned about this. Is it possible for me to catch the alcoholism disease from going to AA meetings? I can’t afford contracting the alcoholism virus at this time.
I don’t understand why the Judge of my Court Case forced me to go to Alcoholics Anonymous. I’m confused as to why the Judge sent me to a place where it is possible for me to contract a disease. The court ordering me to AA seems to go against my basic Human Rights, civil rights, and others.

In Hawaii first time DUI offenders must take a 14 hour substance abuse rehab program course. I am moving back to Florida two days after my hearing and was wondering if anyone new if it was possible to complete the program in Florida? If not I’ll have to fly back to Hawaii just to take this program. To me a “rehab” program can be done anywhere.
