Q&A: If I am the victim of a federal crime?why is it up to me to sue the ones who commit ed the crimes?

Question by Frank G: If I am the victim of a federal crime?why is it up to me to sue the ones who commit ed the crimes?
my clasic mustang was stolen 15 years ago.I was informed of its recovery about 5 years ago .A new investigation proves a police officer had the car for the first 10 years then sold it with out a title to sombody out of state. This being a federal offence. The police wont help, the attorney general wont help, even the prosicuters office blew me off. They say I have to take it up in civil court. Well they know I cant afford a lawyer and its virtually impossable to comply with all the rules fileing pro se. Even though everything can be proven with offical documents from police and statements from both the state police and FBI. I still need a judge to wright the order to return the vehicle! I cant believe the cop ,who now coincidently works for the prosecuters office is willing to risk his entire career and pention over this! He could get 10 years for possesion of a stolen vehical Title 18 chapt.113 ; 2312 & 2313 &1377. Plus he made claims to the police which later proven to be lies. HELP

If you want to sue for damages, you and only you (or your attorney) can file a lawsuite in a civil court. Govt prosecutors have nothing to do with civil courts, where civilians sue each other for compensations. Govt. prosecutors only handle criminal cases in criminal courts. It’s up to you to hire a lawyer to represent you. The lawyer should know what to do. Of course, you could sue the government too if you believe they committed wrongdoing which caused you harms and damages. Just let the lawyer handle the matter.

Since the Constitution specifies that policing power is to be left only to States, why have federal drug laws?

Question by Anti_Censorship: Since the Constitution specifies that policing power is to be left only to States, why have federal drug laws?
During the birth of the US Constitution, it was understood that people had the right to do what they wanted with their own minds and bodies. Why do we now have federal drug laws against marijuana which puts more “offenders” into prisions wasting taxpayer money? Do we really want the government making personal decisions for us?
People smoking marijuana privately in their own homes without causing a problem does not constitute anything close to interstate commerce.

Anyone know the California or federal law regarding storage and access to narcotics in a hospital?

Question by jclockson: Anyone know the California or federal law regarding storage and access to narcotics in a hospital?
I happen to know of a nurse that openly admits she gives the keys to the medication room to unlicensed staff so that they may get ‘other’ items stored in the med-room. I know this is against a few hundred corporate policies, but I need to see if there is a specific law stating that unlicensed staff cannot have unsupervised access to where narcotics are kept.
This is a problem that could potentially cost us our jobs on an upcoming inspection….

Answer by michr
law is not the issue policy is. the nurse is legally responsible for the meds if the nurse gives keys to anyone and something is missing that nurse will be held accountable. report the nurse to the nursing supervisor. this nurse is putting her license at risk as well as her job and could possibly effect the job of others he/she works with. the nurse must inventory and sign for all narcotics under their control at every shift change.
if this nurse did happen to have a “drug problem” and was stealing or failing to properly dispense meds this is an easy way to try and blame someone else. the nurse can now claim she let someone in med room for some other supply and hey stole narcotics. the company would most likely still terminate the nurses employment for failing to follow policy but the nurse just might be able to keep their license.
report the nurse now!!!

You opinion Federal trial set for Shenandoah men charged with hate crime?

Two Shenandoah-area men now know when and where their federal hate-crime trial will begin in connection with the fatal beating of an illegal Mexican immigrant.

Derrick M. Donchak, 20, of Shenandoah, and Brandon J. Piekarsky, 18, of Shenandoah Heights, must appear at 9:30 a.m. Oct. 4 in Courtroom 3 of the Max Rosenn United States Courthouse, Wilkes-Barre, for the start of their trial, which could put each behind bars for life.

U.S. District Judge A. Richard Caputo, who is presiding over the case, issued an order Thursday in which he scheduled the start of the trial and gave each defendant until May 15 to file pretrial motions and supporting briefs.

Caputo ruled the interests of justice justified extending the time for filing such motions and briefs.

The federal trial will represent the second time the men will have faced charges resulting from the beating of Luis Eduardo Ramirez Zavala.

Donchak and Piekarsky are each charged with a hate crime in connection with the fatal beating of Ramirez, 25, of Shenandoah, on July 12, 2008, on a borough street. Donchak also faces charges of obstruction of justice in connection with the beating.

Ramirez died two days after the beating in Geisinger Medical Center, Danville.

A Schuylkill County jury convicted Donchak and Piekarsky on May 1, 2009, of simple assault and alcohol-related offenses, while acquitting both of more serious crimes, including third-degree murder in Piekarsky’s case.

Schuylkill County President Judge William E. Baldwin, who presided over that five-day trial, on June 17 sentenced Donchak to seven to 23 months in prison and Piekarsky to six months and seven days to 23 months behind bars. Each man has been paroled from Schuylkill County Prison and both are on home detention, which restricts them to their residences except for work, education, church, medical treatment, lawyer visits, court appearances and other approved activities.

Three former Shenandoah police officers, Matthew R. Nestor, William Moyer and Jason Hayes, also face charges in connection with allegedly obstructing the investigation of Ramirez’s beating. Nestor, Moyer and Hayes were police chief, lieutenant and officer, respectively.

In an unrelated case, Nestor and former Shenandoah police captain Jamie Gennarini are charged with extorting money from illegal gambling operations in the borough.

All four former police officers have resigned their positions with the borough. Like Donchak and Piekarsky, they are on home detention pending the starts of their trials; Caputo, who also is presiding over those cases, has not scheduled their trial dates

should a federal judge rule in favor of atheist plaintiffs opposed to prayers at the inauguration?

why is it that so many special interest groups file frivolous lawsuits to cram the courts with their cry-baby interests?

i read today (link included) that atheist groups have filed a federal lawsuit to stop prayers being said at obama’s swearing in. this judge finds merit in hearing this case, but the justices of the us supreme court (as well as other courts) refused to hear a case(s) that demanded that obama prove that he is, in fact, a legal citizen of the united states of america, therefore, allowed under the constitution to sit as the president.

okay, so now obama has said to us all, in a news conference, that he’s a citizen of the united states, “case closed” (without real proof presented, only a “certificate of live birth,” which is not the same as a notarized and stamped birth certificate), and there is not a judge in the land that will hear anyone’s lawsuit to force mr. obama to provide the birth certificate. THAT would be an important case because the CONSTITUTION requires a president to be native born so that his/her loyalties cannot be doubted. that is the reason behind that constitutional clause, and mr. obama was a professor of constitutional law. but since he says that the “case’s closed,” it just goes over our heads, as though because The One(c)(TM) has said it, we are not to question authority. but…

but…

there is nothing in the constitution or the bill of rights (the amendments to the constitution) that calls for separation of church and state. look it up on wikipedia.

it is a widely held false belief that there is wording in the constitution to separate church from state, although i watch here in chicago as new “churches” pop up all over the place–even in store fronts–so that these groups don’t have to pay real estate taxes or any taxes, for that matter. but the minute there’s a fire at a church, who puts it out? the fire department of the municipality that they will not pay. if they were getting robbed of their icons, who would come to catch the thieves? why, of course, the municipal police department! if churches do not have to pay taxes, then why don’t they hire their own police and firemen? but you have never heard of anyone filing suit to make the churches do that, have you?

well, read all about this ridiculous plea to a federal judge here:

http://www.cnsnews.com/public/content/article.aspx?RsrcID=41559

oh! how it injures atheists that prayers would be spoken at the inauguration!!! how terrible it must be for them to handle money, since there are words printed on it that say “in god we trust.” what is wrong with a nation looking to god? who says that there is no god? just because atheists do not believe in god does not mean that there is no god. people that believe in god do not bother them. in fact, they are generous to them to a fault. some churches–dig this–have even set up “services” for atheists! and, there are special AA (alcoholics anonymous) groups just for atheists because atheists have said that they object to asking their “higher power” to assist them in staying sober. c’mon, how ridiculous can it get? are the plaintiffs homosexuals hiding under an umbrella called The Atheist Umbrella, just so that they can have their case heard because they are opposed to the preacher rick warren?

the president of this country SHOULD look to his higher power, a/k/a “god,” for help running this troubled country. and just so that i do not get accused of going into a r – a nt here, i want to hear what you have to say about it. i seek all of your opinions, even those of you that are atheists or in some other way opposed to those at the inauguration that will say prayers, any of them (see the link).
