Question by Anj: What should I expect in court where my Ex has been charged with contempt for failing to pay his child support?
The ADA filed the charge against him. He owes our 3 children over four thousand dollars in back child support. He has changed jobs repeatedly each time making less money. He thinks that makes it alright for him to stop paying his support as ordered. He has also moved several hours away, and hasn’t kept one of his court ordered visitations in a year. I have done everything I could to accommodate him. I have brought the children to him every time they have seen him except for two. These visits are not regular visit. He only stays about fifteen minutes or so and then leaves. This time it’s been over two months since he has seen them. He even missed our youngest child’s birthday. The children feel like they don’t know him anymore, and that he doesn’t know them. He thinks nothing will happen to him when he goes to court. He also threatens me that if he goes to jail, he will never pay his child support again. It really is out of my hands. I filed the case with the state office of child support recovery (Ga.). It has been extremely hard for the children and I since he stopped paying his support. I desperately need some relief through this court proceeding, but I’m not sure what to expect. I appreciate any help, especially if you have been through some thing similar.

They will make him pay a certain amount by a certain time or he will be put behind bars…at least this is what they did to my deadbeat mother of my children

What do you think the sentencing will be for 2 felony drug charges, when the person charged already a felon?

My mom who had previous drug charges back in 2003. She was just charged with 2 felonies and 2 misdemeanors. The 2 felonies are illegal conveyance a felony 3 and possession of drugs felony 5. She had already previously been court ordered into 3 rehab programs, and never had to serve any real time in jail. But I would think with previous felony on her record that 2 new felonies would mean that she will need to serve jail time. Any idea what kind of sentencing she will get? We are in Ohio, Any info you have would be helpful. Thanks!

You opinion Federal trial set for Shenandoah men charged with hate crime?

Two Shenandoah-area men now know when and where their federal hate-crime trial will begin in connection with the fatal beating of an illegal Mexican immigrant.

Derrick M. Donchak, 20, of Shenandoah, and Brandon J. Piekarsky, 18, of Shenandoah Heights, must appear at 9:30 a.m. Oct. 4 in Courtroom 3 of the Max Rosenn United States Courthouse, Wilkes-Barre, for the start of their trial, which could put each behind bars for life.

U.S. District Judge A. Richard Caputo, who is presiding over the case, issued an order Thursday in which he scheduled the start of the trial and gave each defendant until May 15 to file pretrial motions and supporting briefs.

Caputo ruled the interests of justice justified extending the time for filing such motions and briefs.

The federal trial will represent the second time the men will have faced charges resulting from the beating of Luis Eduardo Ramirez Zavala.

Donchak and Piekarsky are each charged with a hate crime in connection with the fatal beating of Ramirez, 25, of Shenandoah, on July 12, 2008, on a borough street. Donchak also faces charges of obstruction of justice in connection with the beating.

Ramirez died two days after the beating in Geisinger Medical Center, Danville.

A Schuylkill County jury convicted Donchak and Piekarsky on May 1, 2009, of simple assault and alcohol-related offenses, while acquitting both of more serious crimes, including third-degree murder in Piekarsky’s case.

Schuylkill County President Judge William E. Baldwin, who presided over that five-day trial, on June 17 sentenced Donchak to seven to 23 months in prison and Piekarsky to six months and seven days to 23 months behind bars. Each man has been paroled from Schuylkill County Prison and both are on home detention, which restricts them to their residences except for work, education, church, medical treatment, lawyer visits, court appearances and other approved activities.

Three former Shenandoah police officers, Matthew R. Nestor, William Moyer and Jason Hayes, also face charges in connection with allegedly obstructing the investigation of Ramirez’s beating. Nestor, Moyer and Hayes were police chief, lieutenant and officer, respectively.

In an unrelated case, Nestor and former Shenandoah police captain Jamie Gennarini are charged with extorting money from illegal gambling operations in the borough.

All four former police officers have resigned their positions with the borough. Like Donchak and Piekarsky, they are on home detention pending the starts of their trials; Caputo, who also is presiding over those cases, has not scheduled their trial dates

Is there a difference in the way someone is charged if the DUI is drug related, not alcohol?

I live in Arizona, and my friend is in jail for a drug (Marijuana) DUI, rather than an alcohol related DUI. It is classified an Aggravated DUI since he lost his license a while back, and unfortunately he is facing another DUI for the same type of thing. I am trying to figure out if there is a difference between the way he is being charged because it is drug related. Any advice would be wonderful at this moment!
