<p><strong><i>Question by buttercup</i>: Does anyone know a GOOD attorney to take a case against possibly several state agencies on percentage?</strong><br />
NEED HELP!  Five years ago, I would have never needed or considered doing this.  We were a very stable middle class family.  I had raised two children and decided to go back to school and take some classes in psychology.  I became very interested in that and social work and soon quit a 20 year job to return to school.  Cutting our income in half was bad but after winning an academic scholarship at the end of two years, I went on for a degree in Social Work.  I drove 100 miles per day to school.  In the meantime, everything went haywire.  I graduated in May of this year and have not gone to work because of family responsibilities.  While in school, I dealed with a son in drug addiction but now with a long period of recovery.  He became a father out of wedlock to a precious baby girl in 2003.  She was abandoned to him at 2 1/2 years old with mother coming back in a few months.  Shortly after, a 1 1/2 year custody battle began that became ridiculous.  He now has custody of her.  Both of them live with my husband and I.  His work has been cut by the economy to part time.  He has no government help or child support aiding with this child.  My husband has just had a week a month cut from his job due to economy.  Our savings have dwindled away with attorney fees, medical bills, even with a bond to get me out of jail on a false criminal charge.  If not for my education, I would have never considered this lawsuit, but I have watched wrongdoing of Childrens Services, classism, false accusations placed in agency files and passed around to others for months concerning me when they were not only untrue but could have been easily tested for validity.  Some of these things I have documentation of, a tape recorded interview with the head of an agency showing many mistakes, etc.  Other things, I have very strong circumstantial evidence concerning.  Nobody here wants to fight the state.  The DA&#8217;s office sure doesn&#8217;t want to be involved when they work for the state also.<br />
Some of the many issues include:<br />
1) Sexual abuse of my then 2 1/2 year old granddaughter.  The story came to me after a long period of talking about this person in a very traumatic story one night after seeing his father who looked very much like him.  I asked her to tell dad and granddad the next morning.  She said enough without going into details as she did with me.  They took her to Childrens Services.  It was thought that I MANIPULATED the child to tell this, and I doubt was ever even documented.<br />
2) Mother and father still had custody but both sets of parents were ordered by the court to supervise with parents at all times, including me.  At the same time, they held a document saying that I was believed to have character flaws, mental illness, abuse prescription drugs, and take illegal drugs.  Do you leave a child with a parent that needs supervision to be done by someone like this?<br />
3) I walked out of a Family Meeting according to them because I was unwilling to compromise or something similar.  I did walk out and told them the reason why.  I had listened to what would be to everyone&#8217;s convenience for half an hour.  Not once did I hear anything concerning &#8220;what was in the best interest of the child.&#8221;  They also wanted both parents to sign away custody to grandparents.  My son refused to do so without it being heard before a judge.  I refused to sign to take custody until both parents were said to be unfit before a judge.<br />
4) My son&#8217;s lawyer called and asked to see him and that he bring parents.  When we got there, papers were already waiting for everyone to sign.  Based on a conversation with Childrens Services, she had decided that there was no use representing him.  She wanted him to sign rights to us.  She would then become our attorney and fight to be able to get us JOINT custody with the other grandparents.  She was fired.<br />
5) For about two years this child did not know where home was.  She usually was ordered to spend three days at one place and four at the other.<br />
6) My son had held temporary custody since the abandonment.  One night probably a year into this hearing, she was talking to me in bed before going to sleep.  All of a sudden she said, &#8220;Don&#8217;t you know that my daddy don&#8217;t have custody anymore.  Nana and Papa do&#8221;  I just let it go and said nothing.  The next morning I went to the courthouse to see the documents of the hearing.  She was right!  For 5 months they had held custody of the child.  My son nor any of our family realized this.  It was done on a court date where the judge had plainly said that he would not discuss custody that day&#8230;only visitation.  He sent us in a room to decide on visitation for the next 2 weeks and said when settled, we were dismissed.  The grandparents lawyer came out and returned to the podium.  He said &#8220;your honor, we have one piece of business that we didn&#8217;t address.&#8221;  The judge asked what, and bringing the paper to the judge, he said that it was the visitation agreement that we had made to be signed.<br />
I would LOVE to at least have some more comments here!</p>

This must have been hell for you, I&#8217;m sorry you have had such misfortune.</p>
<p>Apologies for my previous answer,i couldn&#8217;t take it all in as i was sleep deprived from physical pain.</p>
<p>The law here would require some objection to any treatment to have been made within three years of any such treatment-spoken to my solicitor-so his take,if happened in the UK</p>
<p>The solicitor here (UK) would have to have very specialised training on family law,mine has a partner who does this,and she is always working.</p>
<p>The healthy, &#8216;child comes first&#8217; attitude you have ,has been ignored and misunderstood,possibly,and also can be used as some &#8216;fake&#8217; diagnosis to keep lawyers on the take/make</p>
<p>prolongation of cases traumatises the Child and those who love her.</p>
<p>This is horrible to have happened to anyone,of any social background.</p>

			<content:encoded><![CDATA[<p>My aunt&#8217;s boyfriend recently took his ex to court for sole custody of their 7 year old son. This woman has had no contact with the boy for over 5 years, he knows my aunt as mommy and wouldn&#8217;t know who his biological mother was if he ever saw her. My aunt and her boyfriend wanted to protect their son from his egg donor because she, in the last couple years, has been in and out of rehab and has been arrested several times. She became interested in knowing Derek only because she lost custody of two of her other sons to their fathers (she has five sons with four different men). Derek only knows one of his brothers, his older brother and every few months gets to see him. Because of this Derek is not clueless, he knows Joshua is his brother and that they have different fathers but my aunt is the only mother he knows. In court the egg donor continuously lied to the judge and gave out of service phone numbers in the court documents so she was denied visitation but ordered to pay $40 a week in child support &#8211; she claims she can&#8217;t afford that and has no begun talking about terminating her rights so she doesn&#8217;t have to pay. The court appointed Derek his own attorney even though he has no idea what&#8217;s going on. This lawyer told Derek my aunt wasn&#8217;t his &#8220;real&#8221; mom and that he was never in her belly. She also informed my aunt and her boyfriend it &#8220;must be&#8221; confusing to him to have an older brother &#8211; she said this because Derek told her about his older brother and said his brother lives with his father but couldn&#8217;t remember the name of his brother&#8217;s father. I think this woman had no right to tell Derek my aunt wasn&#8217;t his mother when its likely that soon his egg donor will be completely out of the picture for good. My aunt and her boyfriend obviously have no intention to lie to him if he asks about his biological mother but at this point they did not want to confuse him. My aunt wants to do something, such as inform the court that this woman was wrong but doesn&#8217;t know how to go about it. </p>
<p>In your opinion should my family be upset about what this woman told my cousin?<br />
While I do appreciate all of your opinions I have to make it clear that one person in particular obviously did not read clearly. My aunt and her boyfriend never kept the truth from Derek about his biological mother. She came around once in awhile when he was young but never made an effort in the last five years to contact him. My aunt never told Derek she was his biological mother, in fact when he was little they tried getting him to call her by her name but he refused to call her anything but &#8220;mommy&#8221;. Derek is not completely clueless as some of you pointed out he knows he has brothers and obviously my aunt and even his father is not the parent of any of his brothers. As far as my aunt not being involved at all in this court system she had more rights than his egg donor because she&#8217;s been supporting him most of his life and he lives in her house. For example if she and his father split up my aunt could go to court and be given visitation b/c its the best interest of the child.<br /></p>

my mild intellectually disabled friend has decided to move out of home he&#8217;s 24 doesn&#8217;t always make the best financial choices sometimes and drinks a lot border-lining on alcoholism because his parents insist on controlling his life, they give him little or no say in anything and make decisions and choices for him that he gets no say in, they don&#8217;t listen to him which is why he wants to move out so he can be independent.</p>
<p>he&#8217;s now telling me that because he has decided to move out on his own his parents have decided to take him to court to get power of attorney.</p>
<p>can they do that?<br />
is there any basis to their argument if they base their reason on his disability?<br />
can the fact that they take money off him and give him very little to spend and his money is placed in his mother&#8217;s name and she won&#8217;t give it to him even though she promised to when he hit 21 be used as an argument in his defence?<br />
could it also be used in his defence that the reason he can&#8217;t handle money is because he really hasn&#8217;t had any (see point above) to learn how to control it?<br /></p>

			<content:encoded><![CDATA[<p>I am very confused with this case. My very own mother, who is a drug addict and has many mental health issues such as Bipolar Disorder, Manic Depression, Schizophrenia with Psychotic Episodes as well as does the man that she married 2 years ago that she met in a Psychiatric Hospital and only knew for 3 weeks before she married him, took custody of my girls from me. My ex husband stabbed me 4 times in the face and neck 2 days after Christmas and left me for dead. Luckily I survived. I took my girls and went to live with my mom because I had no where else to go and she told me she was going to help me. I was having a very hard time sleeping at night because of the nightmares and I was having panic attacks. My mom started giving me xanax to help me sleep and stay calm. Out of nowhere, my mom went to the DHS and made up a bunch of lies and told them I was all strung out on drugs which was not true. I asked for a drug test and they refused to give me one. When we went to court, the judge would not even let me speak the first word or defend myself. I didn&#8217;t have an attorney. I had no clue that she had made up so many horrible lies on me and all the while she was on drugs herself. My mom was issued temporary emergency custody of my girls. I was ordered to do a drug program. I had a full time job and I asked if I could do outpatient and I was told no. When I finally got the court order 6 months later, it said impatient was preferred not ordered. So I couldn&#8217;t complete an impatient program because I had a home, a car, and I still financially supported my girls. The company I worked for went out of business in May and I immediately began a new job. That job ended in September and I immediately began another job. When I went back to court in October, my mother gave custody to my ex husbands great grandmother and great aunt. They ordered me to have no contact with my girls and I dint understand why. In court, they jumped my case saying I should have done outpatient and I tried to explain to the judge that I called and asked my caseworker and she told me that it was unacceptable. Its a messed up court system. I wasn&#8217;t even allowed to speak in court. I tried to speak one time and I was told that if I spoke again I would be held in contempt of court. So all I could do was remain quiet while my so called mother sat right beside me and lied on me. The judge told me I had to quit my job and the only thing I was to do now was go to rehab. Well, I quit my job. I am on a waiting list to get into a rehab that I found that would take me without insurance. I have at least 4 more weeks left on the waiting list. I go to court in March and I know his family is going to fight me for full custody. I dint know what to do. I am by far not a bad mom. I have never so much as spanked my kids ever. I have taken care of them by myself while being in a very abusive relationship with their father. I ha vent spoken to or seen my girls in 2 months today and Im about to lose my mind. My girls love their Mommy and they cry to be with me. They carried them out of the courtroom crying that they want their Mommy and they love their Mommy and she is not a bad person. Its killing me to know that they want me so bad and I cant do anything about it. No one has even explained to my babies why Im not there.  They have no clue what is going on.  Its so unfair!!!!!!  I don&#8217;t understand how this could happen when they had no evidence against me. All they had was my moms word and she is legally crazy!! I cant afford an attorney now because the judge ordered me to quit my job till I go to rehab. I need an attorney to represent me in court in March or I could possibly lose custody of my girls for good and for no reason at all. Can anyone help me with this situation?? All I want is my babies back so we can go back to being a family like we were before my husband tried to kill me.  I love my babies with all of my heart and would never put them in harms way and they will tell you that themselves.  What do I do before I do lose my mind??<br /></p>
