alcoholism runs in our family?
Posted by admin in Drug & Alcohol Laws on September 25, 2011
Question by st: alcoholism runs in our family?
I am worried that our 2 year old daughter will watch and see what goes on, and be more inclined to drink when she is older. I feel like I am the only one who can stop it, but i dont know what to do, or if it is likely she will become an alcoholic. My Mother in law and Father in law are both heavy drinkers. My mom and dad are also drinkers, but not alcoholics. my husband has beer in the house all the time, but he is not drunk in front of her, although he does drink a few in front of her.

% of alcoholism in NJ? How to stop it?
Posted by admin in Drug & Alcohol Laws on December 8, 2010
Question by LungCancerAssociation: % of alcoholism in NJ? How to stop it?
Curiously, I just wanted to know what is the % of alcholism within adults in the state of New Jersey, USA.
Also, just wondering, what steps can someone take to completely change the state law and render alcohol as an Illegal drug?
All answers, even with little information, are appreciated.
Point to NOTE: I did not ask for a Constitutional amendment in the entire United States. Just like they have different driving ages, can’t we simply ban it in one state, New Jersey in this case.

Alcohol will never again be an illegal drug in the US. Prohibition was tried,it failed so incredibly horribly that it was the only constitutional amendment to ever be repealed. If you insist on trying, you just have to lobby Congress for a new amendment.
No, there is no way to ban alcohol in one state. It would be an abridgement of personal rights. Even if it were technically possible to outlaw alcohol, doing so in one state would be disastrous. Riots would be everywhere.

Is it legal to be fired for asking your boss for a LOA to enter rehab for alcoholism?
Posted by admin in Drug & Alcohol Laws on November 7, 2010
Question by jeafox: Is it legal to be fired for asking your boss for a LOA to enter rehab for alcoholism?
My brother asked his employer for a leave of absence so he could go to rehab for alcoholism (forget that his employer supposedly has an open door policy and programs to help its employees with problems without any reprocussions), his boss responded by firing him. Im pretty sure this is a violation of his ADA rights, but would like to know exactly what laws are being broken and the best way to handle the situation, as my brother cannot afford legal consult.

Answer by Phoenix
I’m pretty sure that is in violation of Family Medical Leave of Absence laws. It would depend what, exactly, your brother was supposedly fired for. In an at-will state (most states), employment is at-will and you can be fired any time for just about any reason. However, you can’t lose your job for requesting FMLA as you are guaranteed 12 weeks per year and your employer has to guarantee your job will be waiting when you return.
Again, the specifics will determine whether it was handled legally or not, but this sounds like a blatant FMLA violation. Usually lawyers will give a first consultation for free and they may take his case on a pay-if-we-win basis (don’t do it for more than 30%!!) He should take advantage of that first consult (make sure when he makes the appt. that it is free).
He could also simply strong arm them by threatening to bring about a FMLA case. Often, if you push just a little, they won’t risk it or won’t bother dealing with it.

In France where people start drinking wine with their meals from early childhood their is less alcoholism or problem drinking. Germany with it’s wonderfull beer festivals has less of a drinking culture and not so many alcoholics. The country I am comparing France and Germany to is Britain, where I live. We have recently changed our drinking laws by having longer opening hours in pubs. It was hoped it would reduce problems caused by drinking and we would have the same culture as continental Europe. However, this hasn’t happened in the year since the law was changed. Our drinking problems have just got worse. It seems to be a problem with the British mentality towards alcohol.
