Q&A: If I get a restraint order on my ex, will it be harder for him to get visitation rights after our baby is born

Question by Voni: If I get a restraint order on my ex, will it be harder for him to get visitation rights after our baby is born
If I get a restraint order on my ex, will it be harder for him to get visitation rights after our baby is born?
Im 3 months pregnant. My relationship with my ex is just NEVER going to function, trust me we’ve tried very hard. He is aggressive, violent, verbally/mentally abusive, started to show recovery of being an alcoholic but went right back, and not to mention that he’s got his priorities all messed up and has already threatened to take our child away after its born.
I want to put a restraint order primarily for my safety and of my unborn child.
Will this also help prove my case in court should he take me there? Would it be harder for him to get and rights on the baby?

am i looking at jail time?

Answer by Nightrider
That can be touchy. Judging the time elements and lack of response in the first part, the Judge is probably considering you a scoff law. Yes, it will help knowing everything has since been completed, but waiting two years is the part that will hurt.
As far as the letter, it is all up to the interpretation by the Judge. Perception is absolute in something of this nature. If you feel compelled to put this in writing, I would seriously suggest getting profession legal help in writing it out. It would be worthwhile to pay an attorney or paralegal to help draft the terminology so it will be perceived in a proper frame of mind.
Best of luck and I hope you can find this useful

Nope. You have to have “good moral character” for most police departments or other law enforcement agencies to hire you. Abusing drugs is pretty much an automatic disqualification.

What to expect from person after completing rehab?
Posted by admin in Uncategorized on July 9, 2010
My friend has battling drug addiction since he was 18, he’s now 38. Because of the addiction, he’s spent most of his life in prison. He’s currently on probation now and has entered a rehab for 6 mos. He’s never worked The Steps. I’m hoping he’s doing this to help himself and to keep from finishing off his sentence. I know it’s going to be a struggle, but I wonder if he can do it. He use to tell me he couldn’t sleep at night, he dreamed of doing crack, he could smell it at times. We didn’t get together because I was scared he was going to relapse and go back to the street. He ended up marrying someone else and what I was scared of happened.
will turning myself into rehab keep me from going back to prison after my 3 tries on prop 36 r used up?

What is the best way to start over after going through a devastating addiction?
Posted by admin in Uncategorized on June 27, 2010
I just want to know if anyone can give me some ideas as to how they started their life over. I am 22 and I had a very devastating problem called bulimia for 5 years. I dropped out of two universities, got pregnant twice, went to jail, failed two treatment programs, almost died of alcohol poisioning, put my family through hell and wasted great amounts of money. All of those things were totally out of character. In high school I was such a conscientous perfectionist. Now I’m back in school and feel lost, scared, lonely, and discouraged because I know that I have to change everything about myself and learn to think in a whole different way about life and about who I am. I now feel that I finally have the strength to change but I am very overwhelmed and I worry a lot and feel guilty. I see a counselor, take an anxiety pill and they are helping but any ideas as to what other things I can do to stay on path to recovery?

After pleading guilty to an underage possession when am I allowed to tell the judge my corrections?
Posted by admin in Uncategorized on June 26, 2010
I got an underage possession charge and I cant afford a lawyer, absolutely 100% cant afford him. The courts have the evidence to find me guilty so I might as well go ahead and plead guilty but I am currently doing a bunch of stuff to stop my alcoholism. At what point am I allowed to tell the judge about this?
Relationship after drug/alcohol abuse?
Posted by admin in Uncategorized on April 26, 2010
My boyfriend of almost 2 years began showing signs of a drinking problem about 6 months ago. He was arrested while drunk for disorderly conduct. After that, he stopped drinking so much, but began again during a visit with his family. He then really kicked his butt out of drinking. However, I recently found out that he traded his alcohol addiction for a meth addiction. He is now in jail after failing a drug test at a hospital b/c he was having feelings of paranoia and anxiety and thought it was a psychological problem–it’s not, it was part of his drug abuse. I’d love some advice on how to move on with my life. We had plans to get married, and I’m just crushed to know of all the lies and deceit that took over this relationship. I still care for him and want to help him but know I NEED to move on with my life without him. Any advice or suggestions of where to seek advice would be much appreciated.
Thanks.
What are the odds of recovery after long term drug and alcohol use?
Posted by admin in Uncategorized on April 26, 2010
My son has used drugs for over 20 years, he is 36. He went back to jail again for breaking probation. He will miss the birth of his son. He has left his wife with no money plus over due bills. He told me he can not stop his drug use even though he is sick of his behave. Is there any hope for him?
Would you ask your son to leave your home after getting out of jail & Rehab? He makes me nervous?
Posted by admin in Uncategorized on February 7, 2010
My 27 yr.old son has been struggling w/drugs & alcohol for 8 years. He had a great job & was very responsible up until last year when he walked away from his job; sold everything, and ended up in jail where later the Judge ordered him into a Rehab. Facility – which he has been to several with no success. He has been living with me now for 2 weeks & no attempts to get a job. I’m disabled on a fixed budget yet he needs to be driven to many places to keep him from violating his probation. I’m nervous around him & he has changed. Yet he has had no urge to do drugs. He say’s he is full of fear. He has no place else to go & if I do ask him to leave he will inevitably end up back in jail or doing drugs again. I’m torn. I seem to worry more than he does about food & having money for gas. I know what he is capable of doing when it comes to work ethics; people love him. Should I be silent & let him work his demons out or stay on his butt to go get a job & get his own place?
What are my rights when returning to work after disability?
Posted by admin in Uncategorized on February 7, 2010
I have been on disability and I have not worked for some time. As I start looking for work, employers tell me I am automatically not qualified because I do not have any recent experience. I had a trauma injury and I have worked very hard in Physical Therapy to improve myself. Can Employers disqualify me on that basis alone? Is there anything I can do? I am working with the Department of Vocational Rehabilitation also. Isn’t this against the Americans with Disabilities Act? How can anyone on disability go back to work if they are automatically disqualified for not having recent experience. It says clearly on the job requirements that you have to have recent experience.
Any thoughts? THANK YOU!
