I have seen many websites saying ‘you can pass your drug test.”
What about court-ordered drug test – can they too be passed? If so, then how is court to know?
I did not want to make people mad, but just ask a simple question.

what kind of ‘order’ is this from the judge?

Question by j: what kind of ‘order’ is this from the judge?
I want my tenants removed from my home. We went to court and agreed (since there was no lease and no written agreement) that I would give them 30 days to vacate and as the jude VERBALLY explained after 30 days they will issue a WRIT and they will be thrown out physically if need be.
However when I look at the ‘settlement agreement’ we all signed in the courtroom there are 3 options at the bottom and the judge marked all 3??
1) no writ of recovery is requested at this time. The signed agreement serves as settlement.
2) Defendant(s) shall vacate on or before 11-16-11 or a WRIT OF RECOVERY shall be issued by default by request and payment of fee.
3) if there is a violation of the above terms, judement may be entered and Plantiff will obatin a Writ of Recovery , upon filing of an affidavit establishing such fact.

SO…is it AUTOMATIC WRIT after 30 days or do I have to go to court again or what??

Best answer:

Answer by Artemis Agrotera
If they do not vacate after the 30 days, you have to go back to court and obtain a Writ – which you will have to pay for. The Writ will be issued automatically – without delay and without your tenants needing to appear.

You would then need to take your signed Writ to the Sheriff’s Department and pay a fee to them to proceed with the physical eviction.

Q&A: If I am the victim of a federal crime?why is it up to me to sue the ones who commit ed the crimes?

Question by Frank G: If I am the victim of a federal crime?why is it up to me to sue the ones who commit ed the crimes?
my clasic mustang was stolen 15 years ago.I was informed of its recovery about 5 years ago .A new investigation proves a police officer had the car for the first 10 years then sold it with out a title to sombody out of state. This being a federal offence. The police wont help, the attorney general wont help, even the prosicuters office blew me off. They say I have to take it up in civil court. Well they know I cant afford a lawyer and its virtually impossable to comply with all the rules fileing pro se. Even though everything can be proven with offical documents from police and statements from both the state police and FBI. I still need a judge to wright the order to return the vehicle! I cant believe the cop ,who now coincidently works for the prosecuters office is willing to risk his entire career and pention over this! He could get 10 years for possesion of a stolen vehical Title 18 chapt.113 ; 2312 & 2313 &1377. Plus he made claims to the police which later proven to be lies. HELP

Best answer:

Answer by calib_forever
If you want to sue for damages, you and only you (or your attorney) can file a lawsuite in a civil court. Govt prosecutors have nothing to do with civil courts, where civilians sue each other for compensations. Govt. prosecutors only handle criminal cases in criminal courts. It’s up to you to hire a lawyer to represent you. The lawyer should know what to do. Of course, you could sue the government too if you believe they committed wrongdoing which caused you harms and damages. Just let the lawyer handle the matter.

Q&A: BONUS POINTS: Lawyer Advice!?

Question by NancyD: BONUS POINTS: Lawyer Advice!?
Case History:
We gave a realtor ,000 to build a house five years ago. He did not build the house and we filed a suit against him four years ago. He dragged the suit using different tactics for four years. In July 2010, we ultimately won triple damages suit for fraud and got a judgement of 6,000. The our attorney asked him to give us his info on assets and accounts which he did not provide. Then our attorney got an order to give us info otherwise face arrest- He did not reply- now our attorney is filing in the court for the issuance of the arrest warrant for him. Now, my question is while we are waiting for the arrest warrant, what rights do we have under law to get info on him, through city, state and federal organizations like IRS, Social Security office and more under the judgement. Should we contact a Collection Agency? How we can make sure that he pays the judgement? What steps our attorney needs to take now for quick recovery other than waiting for arrest warrant? What can we as individuals can and should do for the collection of the judgement amount as we are into the sixth years?

THANKS SO MUCH! Best answer will be rewarded bonus points!!!!

Best answer:

Answer by cactusgene
You can hire a collection agency, but they will most likely charge a 33-1/3% commission. And most are not very good at their job on top of that. If that Realtor owns some property, record your judgment in the county of his real estate holdings. Then you can go to the Sheriff and request a Sheriff’s sale to enforce the judgment. Either someone bids at the sale and you get your cash, or you can bid on it using your judgment as money and become its new owner, subject to any underlying liens.

Q&A: My sis n law was court ordered to get?

Question by woohooo: My sis n law was court ordered to get?
My sis n law was court ordered to get a hair follicle drug test. She was given 10 days to get it done.
She had to pay for it. It’s for a custody battle of her daughter. She’s used. I am sure they will find
it in her system. She didn’t go and it’s past the 10 day mark. Will the court issue a warrant for her arrest, or will they do anything at all about it?

Best answer:

Answer by -
Doubt a warrant would be issues, but she can kiss any chance of getting custody goodbye.

Q&A: Child support garnishment?

Question by k e: Child support garnishment?
Is a custodial parent able to get a child support garnishment on the non custodial parent without the non custodial parent being in arrears? Also, can you get a garnishment by having your lawyer do an income deduction order and having a judge sign it without going to court or thru an agency like child support recovery? Is this a legal garnishment? One more question, when the non custodial parent changes jobs can this type of garnishment automatically follow? Thanks

Answer by violetmom41
Sounds like you’re in Canada, right? If you are you go to Legal Aid and you can request a courtorder form, or you can print the forms from the ontariocourtforms website. I also think you want money from a male exhusband person, who is not living with you or your children. You have to apply each time he changes jobs, and if he quits, that’s difficut to get the money then. If you are working fulltime you will have a hard time getting alimony, but if you’re working part time you might be able to get something, and the child support is till the children are age 25 (if they are attending the university working on a Bachelor’s degree) if they aren’t, then the child support stops.

Is juvenile court supervision less serious than probation?

Question by Will: Is juvenile court supervision less serious than probation?
I was ordered 6 months random drug tests and 12 months court supervision. At the court I was told that the only requirment of my court supervision was that I don’t get arrested again. Is this traditionally how court supervision works? The drug test court order expired 5 months ago and I haven’t talked to anyone at the courts since.

Best answer:

Answer by T
just don’t get arrested, that’s all there is to it…

Is taking a drug diversion class on fridays one of the things an employer cannot fire you for taking a day off?

Question by jriley1337: Is taking a drug diversion class on fridays one of the things an employer cannot fire you for taking a day off?
I need to take fridays off, at the same time I need a job. If I do get a job, and I start, Can I just tell the boss that I need fridays off for the next 4 months? Is drug classes/court ordered stuff a legal reason to take a day off without retaliation from an employer? True they can deny you employment, but what if they let you on?

Best answer:

Answer by Jason C
It is dependent on the state in which you reside. Most employers are not mandated to give you time off for such reasons unless under the care of a Medical Doctor, in which you utilize Federal Medical Leave Act (FMLA).
