how long do I wait to enforce child support payments?


I have been divorced since December however we were separated since 2006. My ex has not paid any child support in that whole time. He is an alcoholic who has got and lost jobs, got and lost places to stay. He is currently in a “rehab program” which was ordered by court from an assault charge right after we divorced. I was granted custody of our 3 children and he has supervised visitation for 8 hrs on weekend. Which has been sporadic because he was in jail until April. I have been supervising on the few occasions(It has not been every weekend and not always for 8 hrs) because I don’t know anyone else to do it. He is staying in what is basically a homeless shelter where his “rehab” is taking place. I don’t know how much longer he has in the program. When should I enforce the child support? Should I wait until he is out of the shelter and has a job? How do I do this?

    Wait until he’s out of the shelter and has a job. He clearly has no money so what’s the point.

    I think if it were me, I wouldn’t want to be enabler. So, yes, I would go to the District Attorney, Child Support Enforcement and I’d slap those child support orders on the D.A. and ask them to enforce them. Not saying you’re going to get any money right away, but at least you’ll be putting a little fire on the ex’s a** to help you support both of your children.

    Sorry, but he’s a big, big boy…he did this to himself and he can get himself out of it.

    You can file a contempt complaint but absolutely nothing will happen until he gets a job. In some states they have maximum amount of months of delinquency he can be allowed and then there is an automatic warrant for his arrest. So, just be patient. Don’t put yourself through a lot of things that won’t get any results.

    you can file right now and what he cant pay will go in earres and he will just have to pay it back when he gets a job. I would do it asap so the court have records that he hasnt paid and needs to pay

    How long can your kids go without eating? Not that long, I’m guessing.
