What steps do i need to take to become domiciliary parent for my son?


My sons dad has been out of town for over a year in a court ordered rehab, but he will be back this month and I know he wants to be in his life, but we were never married both of our names are on the birth certificate. We do not have any type of custody agreement on paper, child support anything. I am scared that he could pretty much take off with him and there is nothing I could really do immediately. The way I understand it in the eyes of the law we share equal rights as far as his custody goes. I need to know where to start to get this on paper. I am single mom and am not sure I can afford to go through a lawyer. Please Help, thanks

    Go to court and file the papers. There will be court fees. Dependng on whether or not he contests you may or may not need an attorney. If you cannot afford an attorney, seek out legal aid or reduced/free legal services in your area. A good google search should be able to provide a number of resources for you. Remember, custody is different than child support so you’ll need to establish both. Do it BEFORE he gets out if possible. Because he’s been in rehab you shouldn’t have any difficulty in getting primary custody.

    file the paperwork for custody…you should have done this by now anyway. You can get a temporary order that will last until the court has it’s final ruling.
