im a person living w/cancer. My meds makes me sick and nausea so i was self medicating myself with marijuana. then i got into a lil trouble with the law,had to drop urine but of corse it was dirty.The judge looked at my fileand yelled my head off about something she didn’t know. “There is no such thing as medical marijuana in the state of Ohio” she said. she ordered me to probation and drug rehab. Iwent to glenbeigh because i didn’t want to go to jail for PV. i talked to somebody there and they sent the info to my probation off.Saying i could stay as long as my dr.didnt put me on meds that contain THC.remind you i didnt get this letter. I go to the dr.during all of this,and told my dr.the problems i was having with the meds.He prescribes Marinol (THC) pills.NOw im taking my meds wiyhout the sickness and everything is going smoothly. Know my probation off. is on my back because Glenbeigh sent her this letter, and she wants me to see if my dr. will change my meds. do i need a lawyer?
the probation officer knows that she’ll be crossing the line,thats why she wants me to take this letter from glenbeigh that was addressed to her and let my doctor see it a try to get me on something else.which im not going to do because i think i have the right to stay on the meds my dr. prescribed. And if i tell her im not going to do that. Would that be considered as violating my pobation?
I THINK MY RIGHTS ARE BEING VIOLATED what do you think?

Well I would get a lawyer but if weed isn’t proscribed to you then it is still considered illegel.

Yeah, you ought to get a lawyer, if for no other reason than to get the charges dropped. While the judge was correct, in theory, she should have been willing to do a little research.

Yes, you do. It is correct that medicinal THC is unlawful in MOST states.
No. Your rights are not being violated – they would be violated only if the ‘act’ was lawful and then you were denied.

In the United States, you have no rights except those which the US Supreme Court says you have. One of those is NOT the right to medical marijuana.
Please don’t mistake this answer for me being judgmental. I’m not judging you at all. I’m simply answering your question. The US Supreme Court has upheld the constitutionality of the federal ban on marijuana, so you have no rights to use medical marijuana at all.

I dont know how to answer this question but I want to see it could hurt to see a lawyer it seems like you have been tho a lot and maybe a lawyer could give you a better look into all of this.

a) You cannot “self medicate” That’s called abusing.
b) There IS no such thing as “medical marijuana. You got caught, deal with it.
c) What the hell do you need a lawyer for? Just be nice to the officer, you’ll find he’s actually nice back.

No, your rights are not being violated…because there are unconstitutional laws on the books that make it illegal for a person to ingest whatever they want to in their body. I do have to say, however, that you do not go to jail and rehab, etc…for smoking weed. You did some sort of crime you are not revealing, and that is what you got into trouble for. the weed just compounded it. If you want to smoke yoiur weed, stop breaking other laws, and they will have no reason to test your pee.

I’m sorry that bureaucratic red tape is causing you pain and suffering. Medical marijuana has so many benefits, when we people realize this?
I would get a lawyer and fight for your right and your doctors right to prescribe you the medication that you need….it shouldn’t be up to anyone but you and your doctor.
Apparantly people do not realize that Marinol is a drug prescribed by a physician and that you are not asking for your right to use marijuana, just Marinol….which is LEGAL!

I have no idea if you can succeed, but your only shot, however slim, is with a lawyer. Look for ACLU, or local “pro-bono” (free) lawyers. If your case is as clear cut as you say, I can easily imagine some marijuana-supporting lawyer wanting to take it on.

hey your right my friend has cancer and is on probation but she get prescribed marinol but doesnt really take it she smokes pot it really makes her feel better than the pills i hope you are ok and are able to recover from this tragedy

No, you simply need to wake yourself up.. about the BS of ‘medicinal marijuana’ — and stop making excuses for your wanting to get high (med. marijuana has only been OK’d to stimulate appetite and for some kinds of eye troubles). You’re looking for sympathy on Yahoo, more than advice. You were caught. You “got in trouble because you had to drop urine” because you think you’ve got it all figured out.. and don’t by a longshot. Focus on living well, learning and earning $$$ legitimately. Take care of your health, and pass the time other ways. If you’re making $$ on the side by selling, or enjoying some kind of elevated social-life by passing a joint here & there.. you’re simply kdding yourself. (If I had to guess, I’d also bet that you have at least one child — and they aren’t mentioned here, and aren’t in the forefront of your mind.. and that’s the drugs pushing themselves before them.)

I wouldn’t say you need a lawyer yet. The probation officer can not say what a dr. can or cant proscribe you.
Also your dr should not give away your medical information without your consent.
You may want to see a lawyer and ask about suing the probation officer for violating your dr- patient confidentiality. And for preventing you from getting vital medication for your cancer.

Where is the violation of your rights? You used an illegal drug and the penalty was to go to drug rehab. Your reasons don’t matter. The probation officer is making suggestions probably based on your parole restrictions. The Marinol may show up in drug tests but it is prescribed by a doctor. I don’t see any problem.

Please get a lawyer. The last thing anyone would want is for you to be violated off probabtion and put in prison. A doctor should be able to prescribe whatever is legal. I just don’t see how a doctor could prescribe something that is illegal, so somehow I think that Marinol must be legal to use in your state. How else could the doctor prescribe it?
Please seek out a lawyer. There is a lawyer somewhere near you that would take this case.

your rights were not violated in any way. people self medicate all the time, and they still go to jail/prison. their problems are usually mental diseases, and they do all the drugs too, and still get in trouble. why shouldn’t you? It’s illegal and you can’t do it.

Having read your post, I don’t see anything in here that indicates your rights are being violated. As for having to do a UA, your probation officer should be aware of the medication your taking.
However, I would agree, that perhaps you should see if there is medication you can take without THC and won’t cause you to feel sick.
If you are on probation for pot, the every time you do a UA the results will show you are positive, there is no way to differentiate between a prescription and actual weed.
It sounds like you probation officer is trying to look out for you best interest. It would suck if you went back to jail if you’re not using.
If you can afford a lawyer then great if not, talk to your doctor and see if there is another medication you can take.
